add Condition No. 74 as follows:

Condition No. 74. That the developer make an in-lieu payment to the City prior to
City Council approval of the first final map for this development
as their portion of the traffic signal installation at Santa Rita
Road and "Trenery Drive". The amount of this payment shall be
established prior to the approval of the tentative map for this
development.

delete Condition No. 58 in its entirety, and modifying Condition No. 70 to allow the
creation of up to 8 lots on the 0.9 acre "entry park" site unless some acceptable
means are found for the maintenance of that part other than creation of a homeowners
association, be introduced.
The roll call vote was as follows:
AYES: . Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler
NOES: None
ABSENT: None

Application of the City of Pleasanton to Drezone approximately one acre immediately
to the west of the Vineyard Villa Mobile Home Park between Vineyard Avenue and the
Arroyo Del Valle to the PUD (Planned Unit Development) High Density Residential Dis-
trict and to prezone approximately one acre immediately west to the extension of
rico (Vineyard~ Avenue and immediately south of the Arroyo Del Valle to the R-1-6500
District

Consider Adoption of Negative Declaration

Mr. Harris presented his report (SR 83:190) dated May 16, 1983, regarding this
matter.

Mayor Butler declared the public hearing open on the application and the negative
declaration.

Ms. Margaret Oyler stated she favored this annexation, and would also like to
include her property in the annexation. Staff advised that because of the lack of
utilities and access to Mrs. Oyler's property it is not feasible to annex her pro-
perty to the City at this time.

No one in the audience spoke in opposition to this item.

There being no further testimony, Mayor Butler declared the public hearing closed
on the application and the negative declaration.

A negative declaration was prepared in conjunction with the general plan amend-
ment on the subject property. That change foresaw the type of zoning being proposed
for the property and, therefore, no further environmental consideration is necessary
at this time.

11, 5/24/83
