add Condition No. 74 as follows:

Condition No. 74. The amount of this payment shall be
established prior to the approval of the tentative map for this
development.

delete Condition No. 58 in its entirety, and modifying Condition No. 70 to allow the
creation of up to 8 lots on the 0.9 acre "entry park" site unless some acceptable
means are found for the maintenance of that part other than creation of a homeowners
association, be introduced.
The roll call vote was as follows:
AYES: . Staff advised that because of the lack of
utilities and access to Mrs. Oyler's property it is not feasible to annex her pro-
perty to the City at this time.

No one in the audience spoke in opposition to this item.

There being no further testimony, Mayor Butler declared the public hearing closed
on the application and the negative declaration.

A negative declaration was prepared in conjunction with the general plan amend-
ment on the subject property. That change foresaw the type of zoning being proposed
for the property and, therefore, no further environmental consideration is necessary
at this time.

11, 5/24/83
