REPORTS OF THE CITY ATTORNEY <br />Resolution of Necessity-Bueno Property along Dublin Canyon Road Public Hearing <br />~quires 2/3 vote approval of CitX Council) <br /> Mr. MacDonald presented his report (SR 83:157) dated April 29, 1983, regarding <br />this matter. <br /> <br /> Councilmember Brandes stated he has grave concerns about this intersection and <br />the potential problems that may arise from additional development, particularly the <br />hotel proposed near that location. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council- <br />member Mohr, that Resolution No. 83-191, a resolution of necessity to acquire by <br />eminent domain property needed for the widening of Dublin Conyon Road, be adopted, <br />after making the findings that (1) the public interest and necessity require the pro- <br />posed project; (2) the proposed project is planned or located in the manner that will <br />be most compatible with the greatest public good and the least private injury; and <br />(3) the property described in the resolution is necessary for the proposed project. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mercer, Mohr, Wood, and Mayor Butler <br />NOES: Councilmember Brandes <br />ABSENT: None <br /> <br />Legislative Update <br /> Mr. MacDonald presented his report (SR 83:159) dated May 3, 1983, regarding this <br />matter. He advised that AB 1599 has been changed to eliminate loss of highway users <br />tax, and that the HCD concept of regional fair share has been included in AB 1597. <br /> <br /> It was moved by Councilmember Mohr, and seconded by Mayor Butler, that Resolution <br />No. 83-192, taking the following position relative to certain bills: <br /> <br /> SB 778 (Dills) Compulsory and binding arbitration; Oppose <br /> legalization of employee strikes <br /> <br /> SB 637 (McCorquodale) Subjects cities to jurisdiction of the Oppose <br /> Public Employees Relations Board <br /> <br /> AB 1597 (Costa) Allowing State Housing and Community Oppose <br /> Development to mandate fair share allo- <br /> cations on cities <br /> <br /> SB 575 (Foran) Limits joint and several liability Support <br /> <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br />Amended AgFeement with Council of Alameda relative to Work Furlough Pr.~gram <br /> Mr. MacDonald presented an oral report regarding this matter, stating that the <br />County had first agreed to pay the workers compensation insurance related to this <br />program but now are asking the City to pay this cost. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by Council- <br />member Wood, not to approve the amendment to the agreement between the County of Ala- <br />meda and the City of Pleasanton relative to the Work Furlough Program, which would <br />require the City to pay the workers compensation insurance. <br /> <br /> 9. 5/lo/s3 <br /> <br /> <br />
