REPORTS OF THE CITY ATTORNEY Resolution of Necessity-Bueno Property along Dublin Canyon Road Public Hearing ~quires 2/3 vote approval of CitX Council) Mr. MacDonald presented his report (SR 83:157) dated April 29, 1983, regarding this matter. Councilmember Brandes stated he has grave concerns about this intersection and the potential problems that may arise from additional development, particularly the hotel proposed near that location. After discussion, it was moved by Councilmember Mercer, and seconded by Council- member Mohr, that Resolution No. 83-191, a resolution of necessity to acquire by eminent domain property needed for the widening of Dublin Conyon Road, be adopted, after making the findings that (1) the public interest and necessity require the pro- posed project; (2) the proposed project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; and (3) the property described in the resolution is necessary for the proposed project. The roll call vote was as follows: AYES: Councilmembers Mercer, Mohr, Wood, and Mayor Butler NOES: Councilmember Brandes ABSENT: None Legislative Update Mr. MacDonald presented his report (SR 83:159) dated May 3, 1983, regarding this matter. He advised that AB 1599 has been changed to eliminate loss of highway users tax, and that the HCD concept of regional fair share has been included in AB 1597. It was moved by Councilmember Mohr, and seconded by Mayor Butler, that Resolution No. 83-192, taking the following position relative to certain bills: SB 778 (Dills) Compulsory and binding arbitration; Oppose legalization of employee strikes SB 637 (McCorquodale) Subjects cities to jurisdiction of the Oppose Public Employees Relations Board AB 1597 (Costa) Allowing State Housing and Community Oppose Development to mandate fair share allo- cations on cities SB 575 (Foran) Limits joint and several liability Support be adopted. The roll call vote was as follows: AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler NOES: None ABSENT: None Amended AgFeement with Council of Alameda relative to Work Furlough Pr.~gram Mr. MacDonald presented an oral report regarding this matter, stating that the County had first agreed to pay the workers compensation insurance related to this program but now are asking the City to pay this cost. After discussion, it was moved by Councilmember Brandes, and seconded by Council- member Wood, not to approve the amendment to the agreement between the County of Ala- meda and the City of Pleasanton relative to the Work Furlough Program, which would require the City to pay the workers compensation insurance. 9. 5/lo/s3
