347 <br /> <br /> Mayor Butler took a moment to recognize Boy Scout Troop 901, who were <br /> in attendance at the meeting and expressed his appreciation of their interest <br /> in civic affairs. <br /> <br /> PUBLIC HEARINGS <br /> Application of L & T Black for PUD (Planned Unit Development) development plan <br /> approval in order to subdivide a five acre parcel into two lots, 1.2 and 3.8 <br /> acres in size, at 2373 Martin Avenue <br /> <br /> Consider adoption of Negative Declaration <br /> Mr. Harris presented his report (SR 83:99) and emphasized the PUD plan <br />was for one parcel only due to the fact that the Blacks wished to sell their <br />home and the other 3.8 acre portion of their property would still be included <br />in the overall planning for the area as Council had previously indicated all <br />seven parcels should be planned as one unit. <br /> <br /> Mayor Butler declared the public hearing open on the application and the <br />negative declaration. <br /> <br /> Mr. Martin Inderbitzen, 62 West Neal Street, spoke to Council on behalf of <br />the Blacks. He presented a letter from Robert Cooper, a neighbor of the Blacks, <br />indicating his support of the proposal. <br /> <br /> There was no further comment either in favor of or opposed to the <br />proposal. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing <br />closed on the application and the mitigated negative declaration. <br /> <br /> Councilmember Mercer indicated Mr. Wiemken had called him from Kansas City <br />and after some discussion, he indicated he was not opposed to this proposal. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, <br />that Resolution No. 83-112, determining on the basis of a review of initial <br />environmental study done for this project, that no significant environmental <br />impact would occur as outlined in the City's guidelines and that a negative <br />declaration is appropriate for a PUD development plan approval in order to <br />subdivide a five acre parcel into two lots, 1.2 and 3.8 acres in size, at <br />2373 Martin Avenue, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded <br />by Councilmember Brandes, that Ordinance No. 1079, to be read by title only <br />and waiving further reading thereof, approving the application of L. and T. <br />Black for PUD (Planned Unit Development) development plan approval in order <br />to subdivide a five acre parcel into two lots, 1.2 and 3.8 acres in size, <br />at 2373 Martin Avenue, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood and Mayro Butler <br />NOES: None <br />ABSENT: None <br /> <br /> -4- 3/22/83 <br /> <br /> <br />
