Mr. Warnick advised that the total cost of this project will <br /> be borne by Prudential Insurance Company, and there will be no cost to the property <br /> owners. <br /> <br />C~ There being no further testimony, Mayor Butler declared the public hearing closed <br />~ on this item. <br />~ It was moved by Councilmember Brandes, and seconded by Councilmember Wood, that <br /> Resolution No. 83-93, after hearing no public protests and after determining that the <br /> public necessity, health, safety, and welfare requires formation of Underground Utility <br /> District 83-1, establish Underground Utility District No. 83-1 on Santa Rita Road be- <br /> tween Valley Avenue and Old Santa Rita Road and on Old Santa Rita Road between Santa <br /> Rita Road and Freeway 1-580, be adopted. <br /> The roll call vote was as follows: <br /> -- AYES: Councilmembers Brandes, Mohr, Wood, and Mayor Butler <br /> NOES: None <br /> ABSENT: None <br /> ABSTAINED:Councilmember Mercer <br /> <br /> Application of Frederic and Jennifer Lin for cancellation of the Williamson Act Land <br /> Conservation Agreement (Agricultural Preserve 1971-73) on an apprpximat.ely 230 acre <br /> site located south of the intersection of rico Avenue and Kottinger Drive at the <br /> southern terminus of Pico Avenue. P.U.q...(Planned Unit Development) <br /> Low Density Residential/Open Space j!~ublic ~alth and ~afety) <br /> Mr. Harris presented his report (SR 83:88) dated March 1, 1983, regarding this <br /> matter. <br /> <br /> Mayor Butler declared the public hearing open on the application and the nega- <br /> tive declaration. <br /> <br /> Mr. Ted Fairfield, Civil Engineer representing the applicant, stated his client <br /> had purchased this property last January from the Hansen family. He stated that only <br /> the 230 acre parcel within the City Limits is included in this application. He ~d- <br /> vised there are no development plans at this time and that this application has nothing <br /> to do with land planning. He stated the findings are self-evident as presented in the <br /> staff report. <br /> <br /> Ms. Susan Long, 3735 Grillo Court, stated that she had requested to be notified <br /> of any meetings regarding this property but that she had not received any notice <br /> relative to this public hearing. Mr. Walker advised this was an oversight on the <br /> part of staff and apologized to Ms. Long for the mistake.
