Mr. Richard Rebholz, 1951 Foxswallow Drive, stated he had moved into this resi- <br /> dence only two weeks ago and knew nothing of the proposed project at the time he <br /> purchased his property. He stated he had previously been involved with a project <br /> similar to this one and advised there are many problems associated with such a com- <br /> plex. He expressed concern that people from the complex could look into his back <br />-- yard and swimming pool area. He stated the complex reminds him of a small Noah's ark, <br /> is not attractive, and should not be allowed in a neighborhood such as Pleasanton <br /> Valley because it will detract from the value of the homes in this area. He ex- <br /> pressed concern regarding traffic. He requested this project be delayed until the <br /> City has time to ascertain the impact of Valley Plaza No. 1 on this area. He ex- <br /> pressed concern regarding liability relative to his pool should someone climb over <br /> the fence into his yard, and also about noise during construction of the project. <br /> He reiterated his feeling that this area should be kept single-family, and that <br /> multi-family residences should be located at some other location in town. He con- <br /> cluded by stating he had talked to some of his neighbors and they were all opposed <br /> to the project. <br /> <br /> Mr. Duncan Matteson, project developer, stated that the units will have a manager <br /> and he did not anticipate any problems as described by Mr. Rebholz. He stated that <br /> the six foot masonry fence should eliminate concerns regarding noise and trespassing <br /> on to private property. <br /> <br /> Councilmember Wood stated he still had concerns about traffic in this area. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing <br /> closed on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, that <br /> Resolution No. 83-92, determining on the basis of a review of initial environmental <br /> study done for this project, that no significant environmental impact would occur as <br /> outlined in the City's guidelines and that a negative declaration is appropriate for <br /> PUD (Planned Unit Development)-High Density Residential zoning and development plan <br /> approval for a 154 unit multi-family residential project on approximately 8.8 acres <br /> of land located at 4323 and 4365 Valley Avenue, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Mercers Mohr, and Mayor Butler <br /> NOES: Councilmember Wood <br /> ABSENT: None <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by Council- <br /> member Mohr, that Ordinance No. 1078, to be read by title only and waiving further <br /> reading thereof, approving the application of Duncan Matteson and John Ferreri for <br /> PUD (Planned Unit Development)-High Density Residential zoning and development plan <br /> approval for a 154 unit multi-family residential project on approximately 8.8 acres <br /> of land located at 4323 and 4365 Valley Avenue, approximately 500 feet west of the <br /> intersection of Valley Avenue and Santa Rita Road, subject to all conditions con- <br /> tained in Planning Commission Resolution No. 2272, and adding an additional condi- <br /> tion that a masonry wall shall be constructed six feet high adjacent to Lots 66 and 67, <br /> and the driveway easement on Santa Rita Road if needed, to mitigate traffic noise, <br /> be introduced. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Mercer, Mohr, and Mayor Butler <br /> NOES: Councilmember Wood <br /> ABSENT: None <br /> <br /> 8. 3/8/83 <br /> <br /> <br />
