There being no further testimony, Mayor Butler declared the public hearing closed <br /> on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, that <br />Resolution No. 83-94, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration is appropriate for <br />cancellation of the Williamson Act Land Conservation Agreement (Agricultural Preserve <br />1971-73) on an approximately 230 acre site located south of the intersection of Pico <br />Avenue and Kottinger Drive at the southern terminus of Pico Avenue, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, and Mayor Butler <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Councilmember Wood <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember .Mercer, that <br />Resolution No. 83-95, approving the application of Frederic and Jennifer Lin for can- <br />cellation of the Williamson Act Land Conservation Agreement (Agricultural Preserve <br />1971-73) on an approximately 230 acre site located south of the intersection of Pico <br />Avenue and Kottinger Drive at the southern terminus of Pico Avenue as submitted under <br />the provisions of 51282.1, subject to the following conditions: (1) that the owner <br />be aware that the tentative cancellation of the agricultural preserve contract on the <br />subject property does not constitute any type of development plan approval by the City <br />and that development of the subject property shall be subject to the standard develop- <br />ment review procedures of the City; and (2) that within one year of the effective date <br />of this tentative cancellation, the owner shall secure final subdivision map approval <br />for the entire project, and in the alternative the owner may pay the full cancellation <br />fee on the property, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, and Mayor Butler <br />NOES: Councilmember Wood <br />ABSENT: None <br /> <br />MATTERS CONTINUED FOR DECISION <br />Industrial Pretreatment Program; Introduction of an ordinance of the City of Pleasan- <br />ton relating to the control and use of the sewerage system and regulating discharge <br />thereto <br />(Contd. from 1-25-83, 2-8-83~ and 2-22-83) <br /> Mr. Warnlck Dresented the report of the Assistant City Attorney (SR 83:90) dated <br />March 2, 1983, regarding this matter.
