Zoning for the propertX is "A" (Agricultural) and R-1- <br />6500 ~Singie-fa~ily Residential) Districts <br /> <br />Consider adoption of Negative Declaration <br /> Mr. Harris presented his report (SR 83:86) dated March 1, 1983, regarding this <br />matter. <br /> <br /> Mayor Butler declared the public hearing open on the application and the nega- <br />tive declaration. <br /> <br /> Mr. Mogens Mogensen, architect for the project, reviewed the design planning for <br />this development, which is basically the same as Valley Plaza No. 1 located on the <br />south side of Valley Avenue. He stated the project is attractive both inside and <br />outside, has an excellent location, has a loop road within the project, parking <br />around the perimeter, the project acts as a buffer between the residential and the <br />commercial area, and there is gate access to the shopping area. He stated that after <br />meeting with the residential neighbors the developer has provided additional land- <br />scaping, has agreed to construct wood and masonry fences, and will construct a solid <br />masonry wall along Valley Avenue for sound mitigation. He reviewed the setbacks; <br />density; parking; open space which includes private open space, recreation building, <br />pool and spa, and tennis courts; air conditioning; insulation; washer and dryer; and <br />private patios or large balconies. He stated the developer is proud of the proposed <br />development plan, and he requested that it be approved. <br /> <br /> Councilmember Mercer asked if negotiations had been completed for purchase of <br />property to provide access to Santa Rita Road. Mr. John Ferreri, 865 Abbie Street, <br />one of the developers of the project, advised that negotiations are in progress at <br />this time but as yet have not been finalized. Councilmember Brandes asked if the <br />City could condemn this property if the developer is unable to purchase it. The City <br />Attorney advised that this is within the City's purview. <br /> <br /> Mr. Ferreri stated that after approval of Valley Plaza No. 1, the developer had <br />come back later and requested a reduction in the park dedication fees. He stated he <br />would like to go on record at' this time that it may be necessary to again request a <br />reduction of park dedication fees for Valley Plaza No. 2, however, it is not known <br />now if that will be the case. <br /> <br /> Mr. Ferreri stated he would also like to go on record thanking the neighbors and <br />the City staff for their cooperation in working with the developer to mitigate the <br />various concerns of everyone. <br /> <br /> Mr. Ike Slabaugh, 2112 Tanager Court, stated he had concerns about the 35 foot <br />access through E1 Rancho and Mission Plaza, and also about the kind of fencing that <br />will be used and how far the development will be from his property.
