(Intro. 2-22-83, 3-Ayes, 2-Noes) <br /> Mayor Butler stated that Ordinance No. 1074 was introduced on February 22, 1983, <br />by a vote of 3-Ayes, 2-Noes, and that it was now in order to adopt the ordinance. <br /> <br /> Councilmember Mohr asked if the City would be liable if this ordinance was not <br />adopted. The City Attorney advised that the City could be subject to lawsuit as well <br />as attorney fees if not in compliance with state mandate. <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Wood, that Ordi- <br />nance No. 1074~ relating to the expiration and extension of tentative subdivision map <br />approvals amending Section 2-3.12, and deleting Section 2-3.13 of Article 6 (The Final <br />Map), and adding Sections 2-2.51 and 2-2.52 to Article 4 (Tentative Map), Chapter 1 <br />(Subdivisions), Title II (Zoning and Development) of the Ordinance Code of the City of <br />Pleasanton, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Wood, and Mayor Butler <br />NOES: Councilmembers Brandes and Mercer <br />ABSENT: None <br /> <br />SPECIAL REPORTS <br /> There were no Special Reports presented at this meeting. <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br />Actions Taken by the Design Review Board and Planning Commission at their meeting <br />of 2-23-83 <br /> Mr. Harris presented his report (SR 83:78) dated March 1, 1983, regarding this <br />matter for the information of the Council. No action was required or taken by <br />Council on this item. <br /> <br />REPORTS OF THE CITY MANAGER <br />Further Discussion of Land Transfer to Zone 7 for Administrative Offices <br />(Contd. from 2-22-83) <br /> Mr. Walker presented his report (SR 83:92) dated March 2, 1983, regarding this <br />matter. <br /> <br /> Mayor Butler stated he was concerned about getting some type of assurance that <br />Zone 7 will proceed with the building, before turning loose of the land. <br /> <br /> Mr. Mun Mar, General Manager of Zone 7, stated he could have his Board pass a <br />Resolution of Intention to assure use of the land for administrative offices. He <br />reviewed the process necessary for deeding the land from the City to Zone 7, and <br />then requested that Council accept the Resolution of Intention from Zone 7 instead <br />of requiring an agreement, in order to expedite the deed processing as soon as pos- <br />sible. He stated that Zone 7 intends to use Capital Improvement Funds to construct <br />the building and that the Zone would begin immediately with architectural plans after <br />acquiring the deed for the property. He advised that completion should be accom- <br />plished by the summer of 1984. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council- <br />member Brandes, that Resolution No. 83-96, approving the concept of transferrin~ the <br />3.3 acres of the Sports Park adjacent to the Zone 7 wells on Hopyard Road to Zone 7 <br />to construct administrative offices; and authorizing staff to negotiate an agreement <br />with Zone 7 to be brought back to Council for approval, clarifying the conditions <br />under which the City will release the property, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br /> 11. 3/8/83 <br /> <br /> <br />
