269 <br /> <br /> Ms. Sandy Shield, 7781 Redbud, stated that Mr. Cross is extremely neat and she <br />would have no objection to him having a business in her neighborhood. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> Councilmember Brandes stated that his concerns had been relieved and that he <br />could now concur with actions taken by the Planning Commission in approving this <br />conditional use permit. <br /> <br /> It was moved by Councilmember Brandes, an~ seconded by Councilmember Mercer, that <br />Resolution No. 83-50, denying the appeal and approving UP-82-24, application of James <br />Cross and Texaco, Inc., for conditional use permit approval to operate a service sta- <br />tion, not including the sale of gasoline, at 44 Mission Drive, subject to all condi- <br />tions contained in Planning Commission Resolution No. 2258, after making the follow- <br />ing findings: (1) that the proposed location of the conditional use is in accord with <br />the objectives of this chapter and the purposes of the district in which the site is <br />located; (2) that the proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be detrimental to the public <br />health, safety or welfare or be materially injurious to properties or improvements in <br />the vicinity; and (3) that the proposed conditional use will comply with each of the <br />applicable provisions of this chapter, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember Mohr left the meeting at 9:25 P.M., due to illness. <br /> <br />Application of Victor Lund, et al, for cancellation of Williamson Act Agricultural <br />Preserve Contract 1974-15 under the provisions of California Government Code Section <br />51282.1. This application proposes to remove approximately fifty-three (53) acres <br />of land from the above-noted contract located at the eastern termini of Junipero <br />Street and San Jose Drive. A conceptual plan indicatin8 potential future subdivi- <br />sion into sinSle family residential lots has been submitted by the landowner as <br />part of this application. No development plan~ however~ shall be approved under <br />this cancellation. Review of future development of the subject property shall <br />occur at later proceedinSs in conformance with the law <br /> <br />Consider adoption of NeSative Declaration <br /> Mr. Harris presented his report (SR 83:51) dated February 3, 1983, regarding this <br />matter. <br /> <br /> Mayor Butler declared the public hearing open on the application and the negative <br />declaration. <br /> <br /> Mr. Vic Lund, applicant, stated he concurred with the staff report. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing closed <br />on the application and the negative declaration. , <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, that <br />Resolution No. 83-51, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration is appropriate for <br />cancellation of Williamson Act Agricultural Preserve Contract 1974-15 under the pro- <br />visions of California Government Code Section 51282.1, to remove approximately fifty- <br />three (53) acres of land from the contract located at the eastern termini of Junipero <br />Street and San Jose Drive, be adopted. <br /> 7. 2/8/83 <br /> <br /> <br />
