437 <br /> <br /> Mayor Butler declared the continued public hearing open, <br /> <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> <br /> Mayor Butler declared the public hearing closed. <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Mercer, that <br />Ordinance No. 1067, to be read by title only and waiving further reading thereof, <br />approving the application of the City of Pleasanton to rezone approximately 13 acres <br />of land located on t~e south side of Bernal Avenue extension between the eastern side <br />of the right-of-way of the Western Pacific Railroad Company and the eastern side of <br />the right-of-way of the Southern Pacific Transportation Company from the "0" (Office) <br />and "I-P" (Industrial Park) Djlstrict and to prezone approximately 16 acres adjacent <br />and to the south for a total of approximately 29 acres to the PUD (Planned Unit <br />Development)-High Density Residential District, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mercer, Mohr, and Mayor Butler <br />NOES: Councilmember Brandes <br />ABSENT: Councilmember Wood <br /> <br />Pursuant to Section 8320 et seq. of the Streets and Highways Code of California, <br />the City Council hereby declared its intention to vacate a portion of Old Hopyard <br />Road unnecessary for present or prospective public use~ said portion being an <br />eighty (80) foot wide easement runnin8 from Johnson (Owens) Drive south to its <br />intersection with Hopyard Road (that area of old Hopyard Road lying immediately <br />easterly of the present Shell service station site located at the southeast <br />corner of Hopyard Road and Johnson (Owens) Drive~ more particularly described <br />on maps on file with the En~ineerin~ Division of the City of Pleasanton <br /> Mr. MacDonald presented the report of the Assistant City Attorney (SR 83:13) <br />dated January 5, 1983, regarding this matter. <br /> <br /> Mayor Butler declared the public hearing open. <br /> <br /> No one in the audience spoke in favor of or in opposition to this item, <br /> <br /> Mayor Butler declared the public hearing closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, that <br />Resolution No. 83-14, approving the vacation of a portion of Old Hopyard Road un- <br />necessary for present or prospective public use, said portion being an eighty (80) <br />foot wide easement running from Johnson (Owens) Drive south to its intersection with <br />Hopyard Road, that area of old Hopyard Road lying immediately easterly of the present <br />Shell service station site located at the southeast corner of Hopyard Road and John- <br />son (Owens) Drive, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, and Mayor Butler <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />MATTERS CONTINUED FOR DECISION <br /> This item (Halverson-Juhl property) was considered after Item 6 on the agenda. <br /> <br />SPECIAL REPORTS <br /> There were no Special Reports presented at this meeting. <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br /> There were no Reports of Boards and Commissions presented at this meeting. <br /> <br /> 7. 1/11/83 <br /> <br /> <br />
