It was moved by Councilmember Brandes, and seconded by Councilmember Butler, that <br />Ordinance No. 1166, to be read by title only and waiving further reading thereof, <br />approving the application of the City of Pleasanton to prezone the approximately 276 <br />acre site located on the west side of Foothill Road opposite Stoneridge Drive and <br />extending westerly and northerly to Dublin Canyon 'Road to the PUD (Planned Unit <br />Development)-Low Density Residential and Open Space (Public Health and Safety) Dis- <br />trict, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: Councilmember Wood <br />ABSENT: None <br /> <br />Application of Ollirep ProDerties for PUD (Planned Unit Development) zoning and <br />development plan approval for a i0 unit cluStered'reSidential development proposed <br />for the 0.98 acre site located at 123 Ray Street. Open from 10-16-84')' <br /> Mr. Harris presented his report (SR 84:589) dated October 25, 1984, regarding this <br />matter. <br /> <br /> Mayor Mercer declared the continued public hearing open on the application and the <br />negative declaration. <br /> <br /> Mr. Mike Cassutt, applicant, stated that much time has been spent over the last <br />year with City staff and residents in the area to work out an agreeable project with <br />everyone concerned. He stated the proposed plan meets the criteria of planning and <br />the neighborhood concerns. <br /> <br /> Council discussion ensued regarding the removal of a large tree on the property <br />line of Mr. Cavestri on Walnut Drive; the tree is damaging his patio area. <br /> <br /> Mr. Tony Cavestri, Walnut Drive, advised the tree is damaging a brick wall and <br />concrete curb at his residence. He stated the tree is perfect now but as it gets <br />larger it will damage his property to a greater extent. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing closed <br />on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br />Resolution No. 84-567, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration is appropriate in <br />connection with the application of Ollirep Properties forPUD (Planned Unit Develop- <br />ment) zoning and development plan approval for a 10 unit clustered residential develop- <br />ment proposed for the 0.98 acre site located at 123 Ray Street, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by Council- <br />member Mohr, that Ordinance No. 1167, to be read by title only and waiving further <br />reading thereof, approving the application of Ollirep Properties for PUD (Planned Unit <br />Development) zoning and development plan approval for a 10 unit clustered residential <br />development proposed for the 0.98 acre site located at 123 Ray Street, subject to all <br />conditions attached to Staff Report 84:589, with condition number 3 modified as set <br />forth in that staff report, be introduced. <br /> <br /> 9. 10/30/84 <br /> <br /> <br />
