Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. Bill Brinton, representing Morgan Construction Company, 235 Montgomery Street, <br />San Francisco, stated that he was at first unaware of the zoning code that prohibits <br />a subdivision sales office within 200 feet of occupied dwelling units. He advised <br />that as soon as he became aware of this requirement he applied for a variance. He <br />stated the trailer he has been operating out of is an eyesore and he intends to re- <br />move it as soon as possible, if the variance is granted. He advised that the trailer <br />permit runs until July 1985. He advised that there is only one property owner within <br />the 200 foot radius and that he is not opposed to the proposed sales office, as evi- <br />denced by his letter on file in the Planning Department. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by Council- <br />member Wood, that Resolution No. 84-464, approving AP-84-12, appeal of Morgan Con- <br />struction Company of a decision of the Board of Adjustment denying a variance to allow <br />a subdivision sales office within 200 feet of an existing residence outside of the <br />subdivision on property located on the east side of Muirwood Drive approximately 500 <br />feet south of its intersection with West Las Positas Boulevard, after making the find- <br />ings required for approval of a variance based upon the special condition that there <br />is only one party within 200 feet and written acceptance of that situation, and sub- <br />ject to the following conditions: (1) that the variance is approved solely to allow <br />the establishment of a subdivision sales office in the two garages shown on the site <br />plan, Exhibit A, dated 9/5/84, on file with the Planning Department; and (2) instruct <br />staff to approve a minor revision to case UP-84-34, the conditional use permit govern- <br />ing the model home complex for the Brookfield Place development, which relocates the <br />subdivision sales office as approved in that use permit to the garages applied for <br />under case V-84-15, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> Mayor Mercer recessed the meeting at 10:15 P.M. <br /> <br /> Mayor Mercer reconvened the meeting at 10:20 P.M. <br /> <br />Consideration of Ordinance Providing for Transportation Systems Management <br /> Mr. Swift presented his report (SR 84:477) dated September 5, 1984, regarding <br />this matter. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Ms. Karen Fraser-Midd!eton, Transportation Manager for Hacienda Business Park <br />Owners Association, stated this is an excellent ordinance and she urged approval of <br />the ordinance. She stated it is a workable mechanism and will ease traffic conges- <br />tion. She stated this program should be a joint partnership between employers and <br />the City. She urged the City to appoint a TSM Coordinator. She stated that local <br />bus service is essential, and she requested that the survey results be monitored so <br />that employers can keep abreast of what is happening. <br /> <br /> Mr. Jim Dickinson, Kaiser Research Center, stated he had first opposed such an <br />ordinance but after several meetings and further review and clarification of the pro- <br />posed TSM ordinance, he now supports the concept. <br /> <br /> 8. 9/11/84 <br /> <br /> <br />
