Ray Ahner
Brian Benda
Alan Casamajor
Richard Combs
Mary McLaughlin
Sharrell Michelotti
Gene Pons
Tom Sullivan
Chuck Wiedel

and that the panel be instructed to review, cooperatively with staff, the conditions
of approval for our business parks: to assess ways of monitoring for compliance with
those conditions; to recommend mitigation measures where needed; and to recommend a
preferred ongoing method for monitoring, with the anticipated time frame projected to
be one year, be adopted.
The roll call vote was as follows:
AYES: C'ouncilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer
NOES: None
ABSENT: None

Councilmember Brandes requested staff to investigate a mechanism whereby heritage
trees that should be preserved will not be destroyed by developers, and also that
heritage trees not be destroyed by allowing concrete or asphalt to be placed too
close to such trees. Council concurred.

Mayor Mercer stated that conditions of approval for various projects included
landscaping, and he is concerned that landscaping be done immediately so as to pre-
vent washout, especially in the Foothill Road-Sunol area. He stated that the City
needs to address what can be done to stop run-off. Mr. Walker advised he will re-
port back at the next meeting regarding this matter.

Mayor Mercer asked when the road projects throughout the City would be completed.
Mr. Warnick advised that due to the concrete strike the projects have all been de-
layed approximately five weeB,but that all are moving along now.

Mayor Mercer asked when the mechanical coverings on the various buildings would
be painted. Mr. Harris stated that it has not been determined at this time what
color these would be painted. Mayor Mercer stated that conditions of approval re-
quire these mechanical coverings to be painted the same color as the buildings.

Councilmember Wood advised that tomorrow will be the last day to cast ballots
regarding Valley Memorial Hospital.

CITY COUNCIL COMMITTEE REPORTS
There were no City Council Committee Reports presented at this meeting.

MEETING OPEN TO THE PUBLIC
Mr. Roy Howe, 645 Abbie Street, requested Council assistance to overcome a
personal problem at his residence. He stated he moved into his home last February.
In order to provide privacy he erected a four foot high cobblestone wall, part of
which is on City easement. He stated he had checked with the neighbors and none had
objected to the wall. He stated the Director of Public Works stated the wall impeded
vision and would have to be removed or lowered. He stated the wall has been rein-
forced with steel and it would be impossible for him to lower it. He stated he would
accept responsibility for the wall and would like to keep it like it is. Mro Warnick
stated he has two concerns regarding the wall; safety and the City's liability.
After discussion, Council directed Mr. Howe to apply for a Variance for the portion
of the wall that is on his property, and for a revokable license for that portion of

4. 7/24/84
