She would like a commitment from the Council to give the police the incentive <br />to make this a priority. <br /> <br /> Mayor Mercer suggested that a meeting be set up between concerned neighbors, the <br />Police Chief, and the City Manager. He suggested an evening meeting where everyone <br />could sit down and discuss what the problems are and figure out what can be done. <br />He stated a joint effort may be necessary between the police department and the <br />neighborhood. Mayor Mercer asked Mrs. Jennings to give some phone numbers to the <br />City Manager so a meeting could be set up soon. <br /> <br /> Ms. Pat Ferreira, Murray School District Board of Trustees Representative, stated <br />that she is requesting the City to work with them on the Donlon School problem. She <br />stated Mayor Mercer suggested exactly what she thought should be done. <br /> <br /> Mr. M. C. Mosier, 240 Kottinger #16, stated he felt the 911 service and the police <br />department response time has been excellent. Mr. Mosier was concerned about the <br />citizens at 240 Kottinger Avenue with regard to the aluminum flag pole that was in- <br />stalled. He resents it very much because he feels the $1,000.00 that was spent on <br />the flag pole could have been used to fix up the insides of the apartments. Mr. <br />Mosiep had a letter from Congressman Stark who contacted the Pleasanton Housing <br />Authority office, and was told that the flag pole was purchased with the interest <br />of the security deposits that the Kottinger residents have put up. He stated he <br />didn't appreciate this and questioned the legality of the action. He stated there <br />is a law that states that why there is no statute that required landlords to pay <br />interest on security deposits, it would seem only fair, since the money belongs to <br />the tenant until he does something wrong and forfeits the deposit. No recent court <br />decision has dealt with this problem but in an older case, which is still on the books, <br />the court held that a landlord may not use or invest the tenants security deposit. He <br />stated that the inside of the apartments are well kept, but the outside area is a <br />shambles. He said this condition exists because of a lack of maintenance, the grounds <br />are terrible. He indicated they have not had a Housing Authority meeting at Kottinger <br />in two months. He feels that the citizens should have been asked what their deposit <br />should be used for, the entire matter was handled incorrectly. Mayor Mercer suggested <br />that the City Attorney work with Mr. Mosier to help draft a letter asking why and is <br />it legal to spend $1,000.00 of security deposit money without tenants permission. <br /> <br />PUBLIC HEARINGS <br />ApReal of Nation's Foodservice, Inc., of a condition by the Design Review Board <br />approving a signing program for the Nation's Restaurant proposed to be operated in <br />the commercial building located at 5321-K Hopyard Road. The condition prohibits <br />internal illumination of any signing for the restaurant. The property is zoned <br />PUD-Commercial District <br /> Mr. Harris presented his report (SR 84:374) dated July 2, 1984, regarding this <br />matter. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. Dale Power, Vice President of Nation Food Service, 1768 Manor Circle, E1 <br />Cerrito, stated that his organization is a small local company with eighteen loca- <br />tions, the Pleasanton location being the nineteenth. He indicated that the Council <br />should have gotten an information packet outlining their proposal. A rendering, <br />giving a color idea of what they are proposing for their signage on the location <br />was put up on the bulletin board. He stated that the Design Review Board accepted <br />that particular proposal with the exception of not allowing any internal illumination <br />for any of the signage. He felt this would be very detrimental to the viability of <br />that location. He then showed slides of the location being discussed as well as <br />slides of other Nation locations.
