Application of Downtown Centre II for design review approval of three commercial build- <br />ings totalling approximately 16,300 sq. ft., and related facilities on an approximately <br />one acre site at 235 Main Street. Zoning for the property i~ C-C (Central Commercial) <br />Civic Overlav District <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Harris presented his report (SR 84:273) dated May 14, 1984, regarding this <br />matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the negative <br />declaration. <br /> <br /> Mr. William Hirst, 147 Bernal Avenue, applicant for the project, stated he concurs <br />with the staff report except for a portion of Condition 13 which he did not feel <br />accurately reflect the action taken by the Planning Commission. He stated that Plan- <br />ning Commission did not require the applicant to obtain a reciprioc~lparking easement <br />with the first phase. He stated that negotiations are pending for the parking easement <br />and he did not know at this time when it would be completed. He requested this matter <br />be considered at the time Phase II is ready for construction. <br /> <br /> Mr. Harris stated staff is concerned that parking be integrated on Phase I and <br />Phase II, and he felt a formalized agreement should be obtained, and recommended that <br />Council require this be done. <br /> <br /> Mr. Hirst requested that Council not hold up approval of the application until the <br />recipriocal agreement is provided. He stated he did not expect any difficulty in <br />obtaining the easement but felt it unfair to hold up the project for this condition. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing closed <br />on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wood, that <br />Resolution No. 84-254, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />out3. ined in the City's guidelines and that a negative declaration is appropriate in <br />connection with the application of the Downtown Centre II for design review approval <br />of three commercial buildings totalling approximately 16,300 sq. ft., and related <br />facilities on an approximately one acre site at 235 Main Street, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by Council- <br />member Mohr, that Resolution No. 84-255, approving the application of Downtown Centre <br />II for design review approval of three commercial buildings totalling approximately <br />16,300 sq. ft., and related facilities on an approximately one acre site at 235 Main <br />Street, subject to all of the conditions contained in Planning Commission Resolution <br />No. 2475, but amending Condition No. 13 of that resolution as follows: "That the three <br />separate parcels which constitutes the subject property shall be merged in a manner <br />acceptable to the City, and developer shall use best efforts to assure that a reciprio- <br />cat parking easement will be granted between the three parcels and Phase I of the <br />Downtown Centre", be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> 11. 5/22/84 <br /> <br /> <br />
