REPORTS OF THE CITY MANAGER <br />Resolutions Making Application to LAFCO and Agreeing to the Exchange of Property Tax <br />Revenue and Initiating Prezoning - Annexation No. 107 (Ga~m~'Y <br /> Mr. Warnick presented his report (SR 84:182) dated April 4, 1984, regarding this <br />matter. <br /> <br /> Mr. David Melander, Limewood Court, stated he is interested in know how this <br />property will be developed and how it will affect the surrounding property owners. <br /> <br /> Mr. Charles Doda, Applewood Court, asked what zoning is being proposed for this <br />parcel. Mr. Harris advised that the zoning being proposed will be low density and <br />open space zoning. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, that <br />Resolution No. 84-178, making application to LAFCO for Annexation No. 107 (Garms, <br />Foothill Road); Resolution No. 84-179, agreeing to the exchange of property tax <br />revenue in connection with Annexation No. 107 (Garms, Foothill Road); and Resolution <br />No. 84-180, initiating prezoning for Annexation No. 107 (Garms, Foothill Road), be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> Mayor Mercer instructed staff to notify Messrs. Melander and Doda when the pre- <br />zoning public hearing regarding this item is considered by Council. <br /> <br />Recommendation Regarding 1.75 Acre Private Park, Foothill Knolls <br /> Mrs. Bengtson presented her report (SR 84:193) dated April 5, 1984, regarding this <br />matter. <br /> <br /> Councilmember Brandes stated he had met with the developers, City staff, and Park <br />and Recreation Commissioners regarding the proposed park, and that he strongly re- <br />commended approval of the proposal. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br />Resolution No. 84-181, declaring the parcel of land, 1.75 acres located in Foothill <br />Knolls between the 1-680 freeway and the parallel subdivision street, subject to an <br />easement for park and recreation purposes, as surplus; the City determines the fair <br />market value for the property, subject to the easement and obligation to maintain, is <br />$75,000; the City Council determines that because of the location and configuration <br />between 1-680 and the adjacent residential parcel (tract 5065), the only practical use <br />of said parcel is as plottage to tract 5065; the City Council determines that approval <br />of the draft minor modification to PUD 81-7 by the Director of Planning and Community <br />Development and failure of the Planning Commission or City Council to appeal said minor <br />modification shall constitute the planning agency review required by Government Code <br />Section 65402; the City Council finds that the City's retention of an easement for parks <br />and recreation purposes makes use of the subject parcel by other public agencies for <br />park purposes or low and moderate housing purposes impossible, nevertheless, staff is <br />directed to notify said appropriate agencies of this finding pursuant to Governmental <br />Code Section 54220 and not complete the transaction for 15 days from date of said noti- <br />fication; and staff is authorized to negotiate and the Mayor is authorized to sign an <br />agreement with Falcon Development Company which is consistent with these determina- <br />tions and to convey the property pursuant to such agreement, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> 12. 4/10/84 <br /> <br /> <br />
