Zoning for the <br />property is PUD (Planned Unit Development) Medium Density Residential District <br /> <br />Consider Adoption of Mitigated Negative Declaration <br /> Mayor Butler declared the public hearing open on this item and continued to the <br />meeting of April 24, 1984, 8:00 P.M., in the Pleasanton Council Chambers. <br /> <br />AppeaA of Lesher Communications, Inc., of a decision of the Design Review Board relatin~ <br />to Condition No. i of their approval of an approximately 10~00 sq. ft. office building <br />and related facilities on an approximately .5 acre site located at 139 Spring Street. <br />~oni~f~r the property is C-C (Central CommerCial) District <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Harris presented his report (SR 84:162) dated March 20, 1984, regarding this <br />matter. <br /> <br /> Mayor Butler declared the public hearing open on the appeal and the negative declara- <br />tion. <br /> <br /> Mr. Jack Bras, Architect representing the appellant, stated this appeal represents <br />a decision made by the Planning Commission to save a walnut tree in the parking lot of <br />the proposed development. Mr. Bras advised that the tree is detrimental and it also <br />removes two parking spaces. He advised that if the tree is placed in a planter that <br />it will die. He stated the tree is an ugly walnut tree and is wrongly placed on the <br />lot. He advised that the project will install thirteen new trees as well as shrubs and <br />groundcover. Mr. Bras stated the proposed development is an investment in downtown <br />~leasanton and will handsomely enhance the downtown area. <br /> <br /> Mr. Dean Lesher, Orienda, representing Lesher Communications, Inc., stated that he <br />strongly supports the preservation of trees but is against the saving of this particular <br />walnut tree. He stated that it is an ugly tree and does nothing to add to the project. <br />He advised that the 10,000 sq. ft. building is necessary to allow for future growth, <br />adding that the business will ultimately employ up to 300 people. <br /> <br /> No one in the audience spoke in opposition to this appeal. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing closed <br />on the appeal and ~he negative declaration. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, that <br />Resolution No. 84-149, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration is appropriate for <br />a 10,000 sq. ft. office building and related facilities on an approximately .5 acre <br />site located at 139 Spring Street, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: Councilmember Mohr <br /> <br /> 6. 3/27/84 <br /> <br /> <br />
