REPORTS OF THE CITY ATTORNEY <br />Amendment to Commercial Vehicle Regulation Ordinance - Designated Haul Routes <br /> Mr. MacDonald presented his report (SR 84:112) dated February 22, 1984, regarding <br />this matter. <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Wood, that <br />Ordinance No. 1129, to be read by title only and waiving further reading thereof, <br />amending Title V, Chapter 5, Article 1 of the Ordinance Code of the City of Pleasanton <br />to require trucks to use designated haul routes, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br />COMMUNICATIONS <br /> Mayor Butler stated that he had received a communication from Zone 7 indicating <br />they do plan to proceed with purchase of the property on Hopyard Road for their admin- <br />istration building. <br /> <br />Viacom ResDonse to City Council Resolution No. 84-16 <br /> Ma~r ~u'tler stated that Council adopted a resolution on January 9, 1984, stating <br />that receipt of the Playboy Channel by non-subscribing households is a violation of <br />Viacom's franchise with the City, and asking Viacom to correct or submit a plan for <br />correcting the problem by March !, 1984. He presented Viacom's written response to <br />Council. <br /> <br /> Mrs. Myrt Jones, General Manager of Viacom, reviewed the procedures taken to <br />eliminate any leakage of Playboy onto other channels. She stated that Viacom is <br />prepared to eliminate this reception expeditiously upon notification, should it <br />occur. She advised that Viacom has inserted notifications in all February basic <br />subscribers billings regarding possible unwanted reception of audio and scrambled <br />video of the Playboy Channel on 42-channel convertor boxes and cable-ready VCRs and <br />TV sets. She stated that out of 5,000 notices sent out only five subscribers had <br />responded and their request for correction of their sets has been taken care of. <br />She added that Viatom is willing and wants to respond to any concern or complaint of <br />any of their subscribers, and she feels that Viacom has satisfied the concerns of the <br />Council to the best of their ability. <br /> <br /> Councilmember Brandes stated that this Council does not want any leakage, and <br />he did not feel that Viacom had been very responsible in meeting the requirements <br />and standards that Council has set forth and desires. He stated he felt Viacom has <br />an obligation to the citizens of Pleasanton to remove all leakage of the Playboy <br />Channel, which in his opinion has not been dealt with properly. <br /> <br /> Councilmember Mercer stated he felt that Viacom has cooperated with the Council's <br />concerns and complaints in a satisfactory manner, and he noted that Pleasanton resi- <br />dents have far fewer cable complaints than in most other areas. He added he felt <br />Viacom is doing a fine job. <br /> <br /> Councilmember Wood stated he felt strongly that the Playboy Channel should not <br />be on television, but also felt that Viacom has been responsive to the problems and <br />is doing everything possible to correct the problem. <br /> <br /> Councilmember Mohr stated she has not received one telephone call complaining <br />of Viacom service, and she did not perceive that there is any major problem. <br /> <br /> 13. 2/28/84 <br /> <br /> <br />
