eliminate a required access way from the project to an adjacent City park (Kottinger <br />Park), be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br />Application of Del Prado Homes to convert to condominium ownership and subdivide 94 <br />existing rental dwelling units on approximately 3.8 acres of land located at the <br />southwest corner of Hopyard Road and Golden Road (the apartments surrounding and <br />including those at 5196 Golden Road) under the provisions of Chapter 15, Title II <br />of the Ordinance Code of the City of Pleasanton. Zoning for the property is RM-15 <br />(Multi-family Residential) District <br />(Contd. Open from 5-24-83, 9-13-83, and 12-6-83) <br /> Mr. Harris presented his report (SR 84:27) dated January 6, 1984, regarding this <br />matter. <br /> <br /> Mayor Butler declared the continued public hearing open on this item. <br /> <br /> Mr. Robert Mitchell, 100 Pine Street, San Francisco, representing Del Prado Homes, <br />stated he is still negotiating with Zone 7 regarding additional parking space for the <br />complex and hopes to reach agreement on this matter shortly. He addressed the issue <br />of rent increases, stating that rental rates for all tenants residing in the apart- <br />ments at the time of application for condominium conversion have been frozen since <br />that date. He stated he favored the first option listed in the staff report which <br />would be to accept the applicants' interpretation that rent increases on vacant units <br />are allowed to them by virtue of their March 1, 1983 application date. Mr. Mitchell <br />stated the aims of the condominium conversions ordinance have been accomplished and <br />he requested that the application be approved. <br /> <br /> The following persons spoke in opposition to this item: <br /> <br /> Mr. Steve Hughes, 587 Touriga Court, stated he has previously managed and owned <br />apartment complexes, and he abhored the idea of an owner making money at the expense <br />of tenants. He advised he is against condominium conversion all together. He re- <br />quested that if this application is approved, that the developer be required to live <br />up to the letter of the law. <br /> <br /> Mr. Jerry Morrow, 6890 Via Quito, stated there are very few apartments in Pleasan- <br />ton, and this is a necessary type of housing for senior citizens and young people, <br />therefore he would urge Council to turn down this application for condominium conver- <br />sion. <br /> <br /> Mr. Robert Mitchell rebutted by stating that 90% of the tenants were in favor of <br />the conversion at the time of initial application, as it would provide them an oppor- <br />tunity to purchase their dwelling unit. He reviewed the advantages of the tenant pack- <br />age being offered to rentors in the complex. He stated that all tenants had been <br />notified of this public hearing and there was no indication of any opposition to the <br />application. Mr. Mitchell advised that he needed preliminary approval of the applica- <br />tion in order to proceed with negotiations with Zone 7 for additional parking in the <br />Arroyo area. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing closed <br />on this item. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council- <br />member Brandes, that Resolution No. 84-17, approving the application of Del Prado <br />Homes to convert to condominium ownership and subdivide 94 existing rental dwelling <br /> <br /> 7. 1/9/84 <br /> <br /> <br />
