units on approximately 3.8 acres of land located at the southwest corner of Hopyard <br /> Road and Golden Road (the apartments surrounding and including those at 5196 Golden <br /> Road), subject to the following conditions: <br /> <br /> 1. That the process of conversion shall be in compliance with all provisions of <br /> Chapter 15, Title II of the Ordinance Code of the City of Pleasanton (Condi- <br /> minium Conversion Projects); <br /> <br /> 2. That a modification to the standard parking requirement be granted allowing <br /> for 39 of the required 188 spaces to be located partially on land owned by <br /> Zone 7 on the southern boundary of the project site through a permanent license <br /> agreement between Zone 7 and the applicants and their successors. This agree- <br /> ment shall identify the City as a third party beneficiary. City approval shall <br /> be required prior to any party being able to revoke this license; <br /> <br /> 3. That the recommendations outlined in structural, heat loss, acoustical, and <br />~ other technical reports be employed by the applicant to the satisfaction of <br /> the Building Official; <br /> <br />[~ 4. That the subdivision be processed through the tentative and final map proce- <br />~'~ dures of the city; <br /> <br />~[ 5. That the developer be aware that additional requirements of subdivision may <br /> include but shall not necessarily be limited to the following: <br /> <br /> a. that the developer shall submit an on-site existing utility plan; <br /> <br /> b. that the developer shall submit for review and approval by the city, <br /> the proposed project CC&R's and an agreement that the homeowners asso- <br /> ciation shall be responsible for the payment of water and sewer fees; <br /> <br /> 6. That prior to filing a final map, the developer shall execute and record an <br /> agreement, approved by the City Attorney, incorporating 'the terms and condi- <br /> tions of the conversion approval binding the developer and any successor in <br /> interest to provide the assistance to tenants and to improve the project in <br /> accordance with Chapter 15 of the Ordinance Code of the City of Pleasanton. <br /> The agreement shall be recorded and a copy shall be provided to each tenant <br /> occupying a unit on the date of approval of the condominium conversion project. <br /> The agreement shall run to the benefit of any tenant occupying a unit on the <br /> date of the approval of the condominium conversion project and may require <br /> bonds to assure the completion of improvements in accordance with project <br /> approval; <br /> <br /> 7.
