Open from 6-4-85) <br /> Mr. Swift presented his report (SR 85:288) dated June 3, 1985, regarding <br />~ this matter. <br />~ Mayor Mercer declared the continued public hearing open on this item. <br />{l{ No one in the audience spoke in favor of or in opposition to the item. <br />~ Mayor Mercer declared the public hearing closed. <br /> <br /> Councilmember Wood stated that since this condition had existed for many <br /> years before the present owner had resided at this location, and because of <br /> the landscaping, he felt the appeal should be granted. <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by <br /> Councilmember Mohr, that Resolution No. 85-302, after making the following <br /> findings: (a) that because of special circumstances applicable to the proper- <br /> ty, including size, shape, topography, location or surroundings, the strict <br /> application of the provision of the ordinance deprives such property of privi- <br /> leges enjoyed by other properties in the vicinity and under identical zoning <br /> classification; (b) that the granting of the variance will not constitute a <br /> grant of special privilege inconsistent with the limitation on other proper- <br /> ties classified in the same zoning district; (c) that the granting of the <br /> variance will not be detrimental to the public health, safety, or welfare, or <br /> materially injurious to properties or improvements in the vicinity; (d) that <br /> neither present nor anticipated future traffic volumes generated by the use of <br /> the site or the uses of sites in the vicinity reasonably require strict or <br /> literal interpretation and enforcement of the specified regulation; (e) that <br /> the granting of the variance will not result in the parking or loading of <br /> vehicles on public streets in such a manner as to interfere with the free flow <br /> of traffic on the streets; and (f) that the granting of the variance will not <br /> create a safety hazard or any other condition inconsistent with the objectives <br /> of this chapter; therefore, City Council approves AP-85-5, appeal of a deci- <br /> sion of the Board of Adjustment denying the approval of the application of <br /> Stephen McLeod, and allows a variance from the Ordinance Code to allow single- <br /> family residential use without the required covered parking spaces at 1358 <br /> Santa Rita Road, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ABSENT: None <br /> <br /> Adjustment in Sewer Service and Connection Fees <br /> Mrs. Wagner presented her report (SR 85:305) dated June 18, 1985, regard- <br /> ing this matter. Mr. MacDonald advised that the Sewer Service fee adjustment <br /> wil~ have to be adopted as an urgency measure effective July 1, 1985, to be in <br /> compliance with Dublin San Ramon Services District schedule, and that the Con- <br /> nection Fees adjustment will go into effect in sixty days (August 18, 1985). <br /> Mr. Walker advised that the Fairgrounds is not to be included in this <br /> schedule. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> No one in the audience spoke in favor of or in opposition to the item. <br /> <br /> 6-18-85 <br /> -4- <br /> <br /> <br />
