<br />375. <br /> <br /> <br />~ <br />'r'I <br />LD <br />W <br />CD <br /><( <br /> <br />approximately 60 feet east of the intersection of Pleasanton Avenue and St. <br />John Street <br /> <br />Consider Adoption of Negative Declaration <br />Mr. Harris presented his report (SR 85:238) dated May 7, 1985, regarding <br />this matter. <br /> <br />Mayor Mercer declared the public hearing open on the application and the <br />negative declaration. <br /> <br />No one in the audience spoke in favor of this item. <br /> <br />Mr. Jess Spencer, owner of the Mortuary at 675 St. John Street, opposed <br />inclusion of his property in this rezoning application. He stated the mor- <br />tuary was established in 1895 and has been located at its present site for the <br />last thirty years. He felt that changing the zoning to a new type of residen- <br />tial would be very damaging to his business. He advised that if the mortuary <br />is destroyed by fire by more than 50% it could not be rebuilt. He stated the <br />mortuary has long served the citizens of Pleasanton and provides a sales tax <br />to the City of Pleasanton. He added that about ten years ago he had tried to <br />relocate his business on Hopyard Road, which would allow him a modern struc- <br />ture and more adequate parking, but that the application was denied by Council <br />because of neighborhood objections. He requested that his property be deleted <br />from this rezoning application. <br /> <br />Mr. Bernard Adams, Consultant, stated that in all of Alameda County there <br />are only 39 mortuaries, and in the immediate area there are two in Livermore <br />and one in Pleasanton. He stated that loss of the Pleasanton Mortuary would <br />be difficult to replace. He advised that in looking at zoning under the <br />Master Plan there are very few places for this type business, and to relocate <br />would be costly. He stated the present location is a good one and the build- <br />ing is adequate. He urged Council to remove this parcel from the rezoning <br />application. <br /> <br />There being no further testimony, Mayor Mercer declared the public hearing <br />closed on the application and the negative declaration. <br /> <br />It was moved by Councilmember Brandes, and seconded by Councilmember <br />Mohr,that Resolution No. 85-243, determining on the basis of a review of lnl- <br />tial environmental study done for this project, that no significant environ- <br />mental impact would occur as outlined in the City's guidelines and that a <br />negative declaration is appropriate in connection with RZ-85-5, application of <br />the City of Pleasanton to rezone an approximately 1.75 acre site from the C-S <br />(Commercial Service) District to the PUD (Planned Unit Development)-Medium <br />Density Residential District located at 607-675 St. John Street, approximately <br />60 feet east of the intersection of Pleasanton Avenue and St. John Street, be <br />adopted. <br />The ro 11 <br />AVES: <br />NOES: <br />ABSENT: <br /> <br />call vote was as follows: <br />Councilmembers Brandes, Butler, <br />None <br />Councilmember Wood <br /> <br />Mohr, and Mayor Mercer <br /> <br />After discussion, it was moved by Councilmember Brandes, and seconded <br />byCouncilmember Butler, that Ordinance No. 1196, to be read by title only and <br />waiving further reading thereof, approving RZ-85-5, application of the City of <br />Pleasanton to rezone an approximately 1.75 acre site from the C-S (Commercial <br /> <br />- 9 - <br /> <br />5-]-85 <br />
