It was moved by Councilmember Butler, and seconded by Coun- <br /> cilmember Wood, that Resolution No. 85-194, determining on the <br /> basis of a review of initial environmental study done for this <br /> project, that no significant environmental impact would occur as <br /> outlined in the City's guidelines and that a negative declaration <br /> is appropriate in connection with PUD-85-1, application of DeVor <br /> Nurseries for Planned Unit Development zoning and development <br /> plan approval for 95 single-family paired units and 65 single- <br /> family detached residential units on an approximately 25.5 acre <br /> site located south of Mohr Avenue and east of the Southern <br /> Pacific Railroad right-of-way, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Wood, and Vice Mayor <br /> Brandes <br /> NOES: None <br /> ABSENT: Mayor Mercer <br /> <br /> It was moved by Councilmember Wood, and seconded by Council- <br /> member Butler, that Ordinanc No. 1192, to be read by title only <br /> and waiving further reading thereof, approving PUD-85-1, applica- <br /> tion of DeVor Nurseries for Planned Unit Development zoning and <br /> development plan approval for 95 single-family-paired units and <br /> 65 single-family detached residential units on an approximately <br /> 25.5 acre site located south of Mohr Avenue and east of the <br /> Southern Pacific Railroad right-of-way, subject to all conditions <br /> contained in Planning Commission Resolution No. 2626, with the <br /> following exceptions: (1) amend condition number 1 to read "That <br /> the development shall be~substantially as shown on the develop- <br /> ment plan, Exhibit A, on file with the Planning Department"; and <br /> (2) add as condition number 19 "That DeVor Nurseries, Inc., use <br /> of the Phase 2 site shall not be considered a nonconforming use <br /> and that alteration, expansion and rebuilding of the nursery <br /> operation may take place on that site as long as it is used for <br /> nursery purposes", be introduced. <br />~.~e roll call vote was as follows: <br /> AYES Councilmembers Butler, Mohr, Wood, and Vice Mayor Brandes <br /> NOES: None <br /> ABSENT: Mayor Mercer <br /> <br /> PUD-85-2, Application of Trammell Crow Company for rezoning of an <br /> eight acre portion of an approximately 49 acre site from c-c <br /> (Central Commercial) to PUD (Planned Unit Development)-Central <br /> Commercial District or to any other zoning district consistent <br /> with the General Plan.
