The roll call vote was as follows:
AYES: Councilmembers Butler, Mohr, and Wood
NOES: Vice Mayor Brandes
ABSENT: Mayor Mercer

Councilmember Butler stated he is not convinced he has enough
actual traffic information to commit the city to a project that
may or may not have a major effect on the level of service in
this intersection. He stated the design, site plan, and land-
scaping of the project are excellent, however, uncertain traffic
situations in the future would prevent him from making a decision
on the proposed project now. Vice Mayor Brandes and Councilmem-
ber Mohr concurred.

After dicussion, it was moved by Councilmember Butler, and
seconded by Vice Mayor Brandes, to .deny PUD-84-22, application of
Harbor View Investments, Inc., for Planned Unit Development
zoning and development plan approval to construct an approximate-
ly 156,000 sq. ft., 212 unit hotel and related facilities on an
approximately 3.6 acre site located on the east side of Dublin
Canyon Road (11910 Dublin Canyon Road), approximately 0.2 mile
north of Foothill Road.
The roll call vote was as follows:
AYES: Councilmembers Butler, Mohr, and Vice Mayor Brandes
NOES: Councilmember Wood
ABSENT: Mayor Mercer

PUD-85-1, Application of DeVor Nurseries for Planned Unit
Development zoning and development plan approval for 95 single-
family paired units and 65 single-family detached residential
units on an approximately 25.5 acre site located south of Mohr
Avenue and east of the Southern Pacific Railroad right-of-way.
Zoning for the property is "A" (Agricultural) District

Consider Adoption of Negative Declaration

Mr. Harris presented his report (SR 85:190) dated April 16,
1985, regarding this matter.

Vice Mayor Brandes declared the public hearing open on the
application and the negative declaration.

Mr. Ted Fairfield, representing DeVor Nurseries, presented
renderings and reviewed the proposed project. He advised the
only new issue is the fact that DeVor has found that one of their
tenants would like to expand an interim building and it should be
conditioned that this shall not be considered a nonconforming
use. He stated he concurred with staff and Planning Commission
recommendations and conditions.

No one in the audience spoke in opposition to this item.

There being no further testimony, Vice Mayor Brades declared
the public hearing closed on the application and the negative
declaration.

Page 6 4-16-85
