:2:69 <br /> <br /> Consider Adoption of Negative Declaration <br /> Mr. Harris presented his report (SR 85:95) dated February 26, 1985, regarding <br /> this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the negative <br /> declaration. <br /> <br /> Mr. Tom Schutter, 471 St. Marys Street, stated he has been opposed to commercial <br /> and multi-family residential zoning in this area since it was first considered for <br /> rezoning more than a year ago. He stated he would like to keep his property as it <br /> is now, but that multiple dwelling units would create adverse impact on the surround- <br /> ings as well as increase traffic. Mr. Schutter stated he did not feel he had been <br /> properly notified regarding issues for consideration in this area. <br /> <br /> Council explained that the proposed rezoning is to bring this area into conform- <br /> ance with the General Plan, but it should not create any particular change to property <br /> in this neighborhood. <br /> <br /> Ms. Alice Mohr, 431 St. Marys Street, stated she is opposed to the rezoning, but <br /> if rezoning is necessary she would prefer the least amount of high density possible. <br /> She stated she felt that too high density will encourage development, as well as lose <br /> large yard sizes and greenery. She preferred retaining the character of this neigh- <br /> borhood as it is now. <br /> <br /> Ms. Marlene Hadley, 648 St. John Street, stated she would like to see St. Marys <br /> Street zoned to residential, single dwelling homes. She stated that more apartments <br /> will ruin the character of the downtown area. She added that she is concerned about <br /> traffic and the quality of the neighborhood. <br /> <br /> Mr. Merton Murray, representing the Murray property at 418 St. Marys Street, <br /> stated he is in favor of the rezoning to RM-1500. He advised that the majority of <br /> the property in this area is already multiple dwelling units. He felt the traffic <br /> problems will be taken care of by the improvements to Del Valle Parkway, and that <br /> the rezoning will not change the neighborhood. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing closed <br /> on the application and the negative declaration. <br /> <br /> Council discussion ensued regarding the time frame relative to bringingthis area <br /> into conformance with the General Plan, and whether or not it was necessary. Staff <br /> advised that it is necessary to bring the area into conformance with the General Plan <br /> but there is no time frame; State guidelines use the word "reasonable length of <br /> time" - probably a six month figure. However, if additional information is needed <br /> before making a decision, the time can be ext&nded for a longer period. <br /> <br /> After discussion, it was moved by Councilmember Mohr, and seconded by Council- <br /> member Butler, determining on the basis of a review of initial environmental study <br /> done for this project, that no significant environmental impact would occur as out- <br /> lined in the City's guidelines and that a negative declaration is appropriate in <br /> connection with RZ-85-2, application of the City of Pleasanton to rezone an approxi- <br />'mately six acre area composed of all properties located on the north and south sides <br /> of St. Marys Street and the north side of Division Street between Peters Avenue and <br /> the Western Pacific Railroad right-of-way from the R-1-6500 (Single-family Residential) <br /> District to the RM-2500 (Multiple-family Residential) District. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler and Mohr <br /> NOES: Councilmember Wood and Mayor Mercer <br /> ABSENT: Councilmember Brandes <br /> <br /> 5. 2/26/85 <br /> <br /> <br />
