It was moved by Councilmember Mercer, and seconded by Councilmember Mohr, <br />that Ordinance No. 1232, to be read by title only and waiving further reading <br />thereof, approving PUD-80-15-2D, application of Hivest, Inc., for Planned Unit <br />Development Plan approval to construct a two building, 26,190 sq. ft. retail <br />commercial complex on an approximately 2.0 acre site located on the south side <br />of Pimlico Drive approximately 0.1 mile east of Santa Rita Road, subject to <br />conditions contained in Staff Report 85:554, including an 8 foot high wall in <br />back of the project, and that the design of the wall and landscaping be ap- <br />proved by the Design Review Board with automatic appeal back to City Council, <br />be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, Mohr, and Mayor Brandes <br />NOES: Councilmember Wood <br />ABSENT: None <br /> <br />Consideration of the Application of Reza Ghorbani for a Certificate of Public <br />Convenience and Necessity to Operate~a Taxi Service in the City of Pleasanton <br /> Mr. Miller presented his report (SR 85:561) dated November 19, 1985, <br />regarding this matter. <br /> <br /> Mayor Brandes declared the public hearing open on this item. <br /> <br /> Mr. Mark L. Hirsch, Howell and Hallgrimson, 4637 Chabot Drive, represent- <br />ing Tri-Valley Cab, stated they presently have a cab service in the cities of <br />Dublin and San Ramon, and were recntly granted a permit to operate in the City <br />of Livermore. He presented a color chart showing the color of the cabs, which <br />will be orange, so as not to conflict with other cab companies in the area. <br />He concluded by stating that Tri-Valley Cab feels they can provide a benefi- <br />cial service to the community. <br /> <br /> Mr. Keith Wardin, 4611 Third Street, spoke in favor of the cab company <br />permit. He stated there is need for competition, and that the City of <br />Pleasanton will derive benefit from this service. <br /> <br /> No one in the audience spoke in opposition to the item. <br /> <br /> There being no further testimony, Mayor Brandes declared the public hear- <br />ing closed. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Butler, <br />that Resolution No. 85-555, approving the issuance of a certificate of public <br />convenience and necessity to Reza Ghorbani for Tri-Valley Cab; approving the <br />rate structure proposed by Mr. Ghorbani in Section IIE of Staff Report <br />85:561; approving the color of orange for the cabs; and directing Mr. Ghorbani <br />to meet with the city's traffic engineer to find a site suitable for a closed <br />taxi stand, and upon doing so, submit the location to the City Council for <br />approval, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br />AP-85-19, Appeal of a decision of the Board of Adjustment denying the applica- <br />tion of Randy Isaacs for a Variance from the Ordinance Code to increase the <br />maximum allowable floor area ratio to facilitate construction of a 1,339 sq. <br />ft. residential addition to an existing dwelling at 4613 Second Street. <br /> <br /> - 5 - 11-19-85 <br /> <br /> <br />
