MEETING OPEN TO THE PUBLIC <br /> Mrs. Carol Heinlein, 4558 Sutter Gate Avenue, thanked the Council for es- <br />tablishing stop signs on Sutter Gate Avenue at the intersection of Ross Gate <br />Way and Laramie Gate. <br /> <br /> Mrs. Cindy Neuschwander, 6291Calle Fuego, asked that the Aquatic Center <br />be kept open on a year around basis. After discussion, Mayor Brandes referred <br />this matter to the Park and Recreation Commission, and instructed staff to <br />notify Mrs. Neuschwander when this item would be considered by that <br />Commission. <br /> <br />PUBLIC HEARINGS <br />PUD-80-15-2D, Application of Hivest, Inc., for Planned Unit Development Plan <br />approval to construct a two building, 29,740 sq. ft. retail commercial complex <br />on an approximately 2.0 acre site located on the south side of Pimlico Drive <br />approximately 0.1 mile east of Santa Rita Road. Zoning for the property is <br />PUD (Planned Unit Development)-Commercial District <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Swift presented his report (SR 85:554) dted November 19, 1985, regard- <br />ing this matter. <br /> <br /> Mayor Brandes declared the public hearing open on the application and the <br />negative declaration. <br /> <br /> Mr. Randy Schlientz, Architect, Associates Protessions, 4200 East Avenue, <br />Livermore, representing the applicant, stated that since the last Planning <br />Commission meeting approving this application he has met with the Homeowners <br />Association to further discuss various concerns. In general the concerns have <br />been alleviated with regard to the setback, which is now 20 feet, and the <br />wall. He advised that it has been discovered there is an existing storm drain <br />inlet on the west side so it will not be necessary to do the filling as <br />originally proposed. He stated he concurs with the staff report and recommen- <br />dations contained therein. <br /> <br /> Council discussion ensued regarding the wall, landscaping, trash recepta- <br />cles, and emergency access to the rear of the project. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Brandes declared the public hear- <br />ing closed on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, <br />that Resolution No. 85-554, determining on the basis of a review of initial <br />environmental study done for this project, that no significant environmental <br />impact would occur as outlined in the City's guidelines and that a negative <br />declaration is appropriate in connection with PUD-80-15-2D, application of <br />Hivest, Inc., for Planned Unit Development Plan approval to construct a two <br />building, 29,740 sq. ft. retail commercial complex on an approximately 2.0 <br />acre site located on the south side of Pimlico Drive approximately 0.1 mile <br />east of Santa Rita Road, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, Mohr, and Mayor Brandes <br />NOES: Councilmember Wood <br />ABSENT: None <br /> <br /> - 4 - 11-19-85 <br /> <br /> <br />
