Council discussion ensued regarding the type of control that <br />might be used to prevent any traffic flow into this area after <br />7:30 p.m. Mr. Byrnes stated he is agreeable to whatever method <br />Council and staff felt is most appropriate. <br /> <br /> Mr. Ronald Pozzebon, 2808 Longspur Way, representing the <br />neighbors on Longspur Way, stated they feel there will be prob- <br />lems associated with this project. He did not feel the traffic <br />control would be sufficient to handle the problem, and that young <br />people could get behind a control device at night and would not <br />be detected. He stated there is noise from the Popi Lounge. He <br />stated he is also concerned about dirt problems and vandalism. <br />He stated he would like to see something to bring the transition <br />from residential to commercial such as noncommercial office, with <br />gate control. <br /> <br /> Mr. Byrnes stated he was told there was a panic button at <br />Popi Lounge, but if that were not the case it could be added as a <br />condition. <br /> <br /> There being no further testimony, Mayor Mercer declared the <br />public hearing closed on the application and the negative <br />declaration. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Coun- <br />cilmember Butler, that Resolution No. 85-502, determining on the <br />basis of a review of initial environmental study done for this <br />project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration <br />is appropriate in connection with PUD-85-10, application of Hop- <br />yard Partners for Planned Unit Development-Central Commercial <br />rezoning and development plan approval to construct a 7,000 sq. <br />ft. daycare facility, a 7,000 sq. ft. commercial office building, <br />and additional parking area (over the Pleasanton Canal) north and <br />east of an existing shopping center located at the northeast <br />corner of Valley Avenue and Hopyard Road (Hopyard Village), be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br /> After discussion, it was moved by Councilmember Brandes, and <br />seconded by Councilmember Butler, that Ordinance No. 1227, to be <br />read by title only and waiving further reading thereof, approving <br />PUD-85-10, application of Hopyard Partners for Planned Unit <br />Development-Central Commercial rezoning and development plan ap- <br />proval to construct a 7,000 sq. ft. daycare facility, a 7,000 sq. <br />ft. commercial office building, and additional parking area (over <br />the Pleasanton Canal) north and east of an existing shopping cen- <br />ter located at the northeast corner of Valley Avenue and Hopyard <br />Road (Hopyard Village), subject to conditions set forth in Plan- <br />ning Commission Resolution No. 2706, with the added conditions <br />that there be a panic bar exit at Popi Lounge, that there be a <br />traffic control device to prohibit traffic after 7:30 p.m., per <br />specifications approved by the Police and Fire Departments, that <br /> <br /> 10-15-85 <br /> - 14 - <br /> <br /> <br />
