435 <br /> <br /> Mr. Ralph Goodell, applicant, presented renderings of the <br />proposed project, and stated he concurs with the staff report. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer declared the <br />public hearing closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Coun- <br />cilmember Butler, that Ordinance No. 1226, to be read by title <br />only and waiving further reading thereof, approving PUD-84-4-4M, <br />application of Ralph Goodell and Associates/Valley Medical As- <br />sociates for major modification to an approved development plan <br />for a shopping center-medical office complex to increase the size <br />of the medical office building by 1,271 sq. ft. for a total of <br />28,167 sq. ft. structure, on an approximately 7.7 acre site lo- <br />cated at the southeast corner of the intersection of Santa Rita <br />Road and West Las Positas Boulevard, immediately adjacent to the <br />Exxon Station, subject to all conditions set forth in Planning <br />Commission Resolution No. 2711, except that the window sill pat- <br />tern shall be substantially as shown on Attachment 4 of Staff <br />Report 85:514, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />PUD-85-10, Application of Hopyard Partners for Planned Unit <br />Development-Central Commercial rezoning and development plan ap- <br />proval to construct a 7,350 sq. ft. daycare facility, on 8,000 <br />sq. ft. commercial office building and additional parking area <br />(over the Pleasanton Canal) north and east of an existing shop- <br />ping center located at the northeast corner of Valley Avenue and <br />Hopyard Road (Hopyard Village). Zoning for the properties are C- <br />C (Central Commercial) and "P" (Public and Institutional) <br />Districts <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Swift presented his report (SR 85:512) dated October 15, <br />1985, regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the applica- <br />tion and the negative declaration. <br /> <br /> Mr. Tom Byrnes, representing Hopyard Partners, stated that <br />after meetings with the neighbors, Park and Recreation Commis- <br />sion, Planning Commission, and City staff, they are almost in <br />agreement. He stated he disagrees with the use for the 7,000 sq. <br />ft. building. He felt there is enough Office space already, and <br />there is room for retail. He advised there would not be any res- <br />taurants or fast food stores allowed in the building. He stated <br />the use would be stopped by 7:30 p.m. daily.
