He stated that thou- <br /> sands of dollars have been spent on advertising but with the address being <br /> Stoneridge Mall Road and the business being located on Canyon Way, there needs <br /> to be appropriate signing to identify the business. <br /> <br /> Ms. Sharon Kramer, 495 Adams Way, representing Merrill Lynch and the Sam- <br /> mis Company, stated they are in total agreement with Lindsay's to allow them <br /> to have their full name on their business sign. <br /> <br /> Mr. Ken Bryant, Legal Counsel, stated the dispute about the sign is <br /> between Merrill Lynch and Taubman, and the City should not get involved. The <br /> dispute exists but will be resolved. Lindsay's is the helpless victim. If <br /> the sign is not allowed, Lindsay's is the only one to lose money. As a new <br /> business they need identifying signs. He requested the full signage be al- <br /> lowed even if it has to be removed later if the dispute is not settled in <br /> their favor. <br /> <br />- Mr. Larry Beermann, 3514 Kings Canyon Court, Manager of Stoneridge Shop- <br /> ping Center, stated the decision of the Design Review Board should be upheld <br /> pending compliance with the CC&R's of the Center. He cited several businesses <br /> in the area that only use one name to identify their sites, and he felt Lind- <br /> say's would fall within this criteria. <br /> <br /> Mr. Ferrari stated that some businesses are household names while Lind- <br /> say's is not, therefore they should be allowed to have their full business <br /> name on the sign. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br /> closed on this item. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br /> Councilmember Mohr, that Resolution No. 85-472, approving AP-85-16, appeal of <br /> Lindsay's Office Supplies of a decision of the Design Review Board condition <br /> of approval requiring proof of Taubman Company prior to issuance of the build- <br /> ing permits for the approved signs, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br /> NOES: None <br /> ABSENT: Councilmember Wood <br /> <br /> PUD-77-10, Application of Ken Gooch and Associates for a major modification to <br /> amend the grading plan for PUD-77-10, Pleasant Hills, to allow regrading of <br /> lots located at 4931 and 4897 Dolores Drive and 4934, 4942, and 4950 Monaco <br /> Drive to create flat back yard areas in lieu of the natural slope <br /> Mr. Swift presented his report (SR 85:489) dated October 1, 1985, regard- <br /> ing this matter. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. John Vanderoovart, 4300 Del Valle Parkway, representing the applicant, <br /> presented renderings showing the grading configuration proposed. He stated <br /> the regrading will allow larger and more attractive back yards, and it would <br /> not affect other lots in the area. He advised that the three trees proposed <br /> to be removed are diseased and are dangerous in their present condition. <br /> <br /> - 8 - 10-1-85 <br /> <br /> <br />
