No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> Councilmember Butler stated that housing needs have changed since the time <br />this restriction was placed on the application, and since it did not provide <br />any benefit to the City, that it is no longer necessary to have this <br />condition. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Bran- <br />des, that Resolution No. 85-471, denying AP-85-13, appeal by the City of <br />Pleasanton of a decision of the Zoning Administrator; and approving the ap- <br />plication of Jerry Loving and Associates to eliminate Condition No. 3 of PUD- <br />81-20-1M, with all remaining conditions of PUD-81-20 and PUD-81-20-1M remain- <br />ing in full force and effect; and that all tenant provisions of the condomini- <br />um conversion ordinance shall be applicable to the project and that notice to <br />this effect shall be given to all existing tenants within two weeks of this <br />approval, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler; Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />AP-85-16, Lindsay's Office Supplies; Appeal of a decision of the Design Review <br />Board condition of approval requiring proof of Taubman Company approval prior <br />to issuance of the building permits for the approved signs. The property is <br />zoned C-R(p) (Regional Commercial-peripheral)-District <br /> Mr. Swift presented his report (SR 85:475) dated October 1, 1985, regard- <br />ing this matter. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. Mark Ferrari, President of Lindsay's Business Supplies and Furniture, <br />Inc., presented a letter to Council stating it is imperative that they have <br />permanent signs with their full name to identify their business. He advised <br />that Merrill Lynch, the owners of the building, are starting litigation with <br />the Taubman Company on this issue. He stated he has followed the CC&R's to <br />the letter and Feels they are losing business while this is being settled. He <br />stated that customers are unable to find the store because of lack of iden- <br />tification; the store address is Stoneridge Mall Road but the business actual- <br />ly fronts on Canyon Way. Mr. Ferrari presented a letter froIn the Manager of <br />Retail Operations of Lindsay's, listing businesses in the immediate area of <br />the Stoneridge Shopping Mall that have been allowed to have their full company <br />names on their buildings or place of business. He advised there is need For <br />more than just Lindsay's on their sign; as the business is new in this area <br />and the public is not familiar with the type of store and service it provides. <br />He asked to be allowed to install a sign with the full name of the business <br />Lindsay's Business Supplies and Furniture, Inc. He stated he has no problem <br />with the other conditions attached to the application. <br /> <br /> Mr. Harry Jones, Manager Retail Operations for Lindsay's Business Supplies <br />and Furniture, Inc., stated he has been in the merchandising business for 39 <br />years and feels that any legitimate business needs visibility to function.
