Harbour makes their improvements. Mr. Swift stated that Planning Commission
reviewed this situation and agreed to an extension of six months for installa-
tion of the fences. This will allow the neighbors and staff time to determine
what Cork Harbour is going to do. If Cork Harbour does not make the improve-
ments the homeowners can go ahead and make the improvements themselves. After
discussion, Mayor Mercer instructed staff to meet with Mr. Goldsworthy in an
attempt to work out a satisfactory solution to this problem. Mr. Goldsworthy
stated he is agreeable to the six months extention for Cork Harbour to com-
plete their improvements.

Mr. Leo Heckathorn, 4202 Stanley Boulevard, stated he had recently atten-
ded a general meeting of the Carpenters Local, and that Pleasanton is noted
for having the best apprentice training for this group. He thanked Council-
member Mohr and Councilmembers for their efforts in getting the training cen-
ter located in Pleasanton.

PUBLIC HEARINGS
AP-85-6, Appeal of Pacific Ready Mix of a decision of the Design Review Board
denying Case Z-85-52, an application for design review approval to construct a
cement batch plant and a 352 sq. ft. operations office on an approximately 1.1
acre site located approximately 400 feet'southwest of the intersection of
Boulder Street and Valley Avenue. Zoning for the property is PUD (Planned Unit
Development)-High Density Residential
(Contd. Open from 9-3-85)
Mr. Swift presented his report (SR 85:487) dated October 1, 1985, regard-
ing this matter.

Mayor Mercer declared the continued public hearing open on this item.

Mr. Bill Hirst, 235 Main Street, Attorney representing the applicant,
stated this matter was before Planning Commission last month and it was their
decision that this matter should be treated as a minor modification. This was
based on the fact that the rental restriction has nothing to do with the ap-
plicant getting anything from the City; the project already had growth manage-
ment program approval and sewer permits prior to the time the restriction by
way of a minor modification was approved; and the project was conceived and
built as a condonlinium project to be sold. He urged Council to uphold the
action of the Zoning Administrator.

Councilmember Brandes asked if the restriction was agreed to by the
developer. Mr. Hirst advised that the restriction was agreed to by the con-
tractor, not the developer, and that he was not authorized to make such a
commitment.

6 - 10-1-85
