It was moved by Councilmember Brandes, and seconded by Councilmember But- <br />ler, that Resolution No. 85-446, determining on the basis of a review of ini- <br />tial environmental study done for this project, that no significant environ- <br />mental impact would occur as outlined in the City's guidelines and that a <br />negative declaration is appropriate in connection with GP-85-3, application of <br />John Payne et al to amend the Land Use Element designation of the General <br />Plan, and PUD-85-7, application of John Payne et al for rezoning and develop- <br />ment plan approval for the construction of a 38 unit townhouse project on an <br />approximately 2.6 acre site, located at 4089 and 4129 Stanley Boulevard, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember Butler stated he could support this application with the <br />amended conditions as submitted by the applicant's attorney. He stated it <br />should be pointed out that the residents in 9eneral do not stron91y oppose <br />this residential change; and that it is close enough to Main Street that traf- <br />fic impacts are minimal and the project is within acceptable conditions. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember But- <br />ler, that Resolution No. 85-447, approval of GP-85-3, application of John <br />Payne, et al, to amend the Land Use Element designation of the General Plan <br />for an approximately 2.6 acre site, located at 4089 and 4129 Stanley <br />Boulevard, subject to the eight conditions contained in Staff Report 85:447, <br />but amending Condition No. 1 to read "that no building permit for any High <br />Density project be issued until the Del Valle Parkway alignment has been set, <br />and amending Condition No. 2 to read "that no building permit for any High <br />Density project shall be issued until the contract for the construction of the <br />Valley Avenue extension to Stanley Boulevard is let. In the event such con- <br />tract cannot be let by May 6, 1986, developers of property subject to this <br />condition may propose an interim engineering measure to mitigate the short- <br />term impacts of a project on existing Stanley Boulevard. Council approval of <br />such engineering measure shall be deemed to be compliance with this condi- <br />tion", be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />PUD-85-7, Application of John Payne, et al, for rezoning and development plan <br />approval for the construction of a 38 unit townhouse project on an approxi- <br />mately 2.6 acre site, located at 4089 and 4129 Stanley Boulevard. Zoning tor <br />the properties is R-1~20,000 (Single-family Residential) District <br /> Mr. Swift presented his report (SR 85:459) dated September 1/, 1985, <br />regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. John Payne, 3689 Pimlico Drive, reviewed the plans for the proposed <br />project; stating it is a 36 unit townhouse complex, will have an Old Pleasan- <br />ton theme, that as many heritage trees will be saved as possible, that the <br />amount of parking spaces has been increased, and the setbacks have been in- <br />creased. He reviewed measures taken to mitigate noise problems. Mr. Payne <br />requested that Condition No. 4 be amended as presented in his letter. <br /> <br /> 10 - 9-17-85 <br /> <br /> <br />
