RZ-85-18, Application of the City of Pleasanton to amend the Zoning Ordinance
relating to setbacks required for patio covers in R-1 (Single-family Residen-
tial) Districts
(Contd. Open from 1-21-86)
Mr. Swift presented his report (SR 86:46) dated January 30, 1986, regard-
ing this matter.

Mayor Brandes declared the continued public hearing open on this item.

Mr. James D. Downey, 3660 Olympic Court, reiterated his concern relative
to the proposed ordinance, stating he felt it is unfair to those citizens who
have abided by City regulations and paid the permit fees and taxes on improve-
ments made to their property, while others have made improvements to their
property without permit fees. He added that if they are caught they request a
Variance and usually receive approval for it. He stated that after a resident
applies for and receives a building permit the improvement is seldom inspected
by the City to see that it complies with Code.

There being no further testimony, Mayor Brandes declared the public hear-
ing closed.

After considerable discussion, it was moved by Councilmember Butler, and
seconded by Councilmember Mohr, that Ordinance No. 1244, to be read by title
only and waiving further reading thereof, approving RZ-85-18, application of
the City of Pleasanton to amend the Zoning Ordinance relating to setbacks re-
quired for patio covers in R-1 (Single-family Residential) Districts, requir-
ing five feet setbacks for attached and detached patio covers in rear yards
and three feet setbacks for attached and detached patio covers in side yards,
be introduced.
The roll call vote was as follows:
AYES: Councilmembers Butler, Mohr, Wood, and Mayor Brandes
NOES: Councilmember Mercer
ABSENT: None

MATTERS CONTINUED FOR DECISION
There were no matters continued for decision presented at this meeting.

SPECIAL REPORTS
There were no special reports presented at this meeting

REPORTS OF BOARDS AND COMMISSIONS
Actions Taken by the Board of Adjustment, Design Review Board, and Planning
Commission at their meeting of 1-22-86
Mr. Swift presented his report (SR 86:36) dated January 28, 1986, regard-
ing this matter.

Mayor Brandes requested that the following two items be appealed by
Council:

Z-85-408, Application of the Associates for a signing program for their build-
ing located at 4301 Hacienda Drive;

Parapet Signs.

Councilmembers concurred with these appeals.

7 - 2-4-86
