Dr. Robert Connolly, 306 Neal Street, presented his project to Council for <br />their consideration. <br /> Mr. A1 Dutchover, 147 Bernal Avenue, stated that with regard to lot #9 he <br />would like to request the side yard setback be changed from six feet to five <br />feet with a retaining wall. <br /> <br /> Council discussion ensued regarding the preservation and watering of an <br />oak tree in the project. Mr. Swift advised that a condition could be added <br />that would require the homeowner to have the tree checked bi-annually by a <br />tree expert and present a written report to the City, to insure the tree is <br />being properly maintained. <br /> Ms. Bonnie Krichbaum, 303 Neal Street, asked if the PUD zoning means the <br />lots can vary, and if so would the surrounding neighbors be notified. Council <br />advised that the PUD has greater restrictions than the usual residential <br />development approval, and any Variance would be considered by Council if it <br />does not meet all City Codes and the neighbors would be notified; however, if <br />it meets the Code requirements there would be no further public <br />considerations. <br /> <br /> No one in the audience spoke in opposition to this matter. <br /> There being no further testimony, Mayor Brandes declared the public hear- <br /> ing closed on the application and the negative declaration. <br /> It was moved by Councilmember Wood, and seconded by Councilmember Mohr, <br /> that Resolution No. 86-46, determining on the basis of a review of initial <br /> environmental study done for this project, that no significant environmental <br /> impact would occur as outlined in the City's guidelines and that a negative <br /> declaration is appropriate in connection with PUD-85-21, application of Robert <br /> Connolly for rezoning from R-1-6500 (Single-family Residential) to PUD <br /> (Planned Unit Development)-Medium Density Residential District and development <br /> plan approval for a nine-unit, single-family residential project to be located <br /> on an approximately 2.4 acre site located at 306 Neal Street, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes <br /> NOES: None <br /> ABSENT: None <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Wood, <br /> that Ordinance No. 1243, to be read by title only and waiving further reading <br /> thereof, approving PUD-85-21, application of Robert Connolly for rezoning from <br /> R-1-6500 (Single-family Residential) to PUD (Planned"Unit Development)-Medium <br /> Density Residential District and development plan approval for a nine-unit, <br /> single-family residential project to be located on an approximately 2.4 acre <br /> site located at 306 Neal Street, subject to conditions contained in Staff Re- <br /> port 86:47, but allowing lot #9 to have a five foot side yard setback with <br /> retaining wall instead of six feet setback and no retaining wall, and adding a <br /> condition that requires the homeowner of the lot with the oak tree to have the <br /> tree inspected bi-annually by a qualified tree expert and submit a copy of the <br /> report to the city, be introduced. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes <br /> NOES: None <br /> ABSENT: None <br /> <br /> ! 2-4-86 <br /> 6 - <br /> <br /> <br />
