319
be recommended for approval because they did not have approved PUD's, and one
applicant (Amador Valley Savings and Loan) could not apply based upon its con-
ditions of approval. He stated that Shea Homes is the one project which most
urgently wants to receive approval this year; their project is partially built
out and is an on-going project, and the Subcommittee is recommending them for
units. He stated there is a problem with Falcon Development and a proposed
park, which must be resolved before a long term agreement can be finalized
with them.

Councilmember Butler advised that the Subcommittee would like to work out
long term agreements with each individual developer, and at this point would
like Council concurrence to continue in the general direction set forth in the
recommendations as presented.

Councilmember Mercer asked if all the developers involved in this matter
were notified that the issue would be discussed at this meeting. The City
Attorney advised he had contacted every developer except Mozart Development
and Doyle Heaton.

After considerable discussion, it was moved by Councilmember Butler, and
seconded by Councilmember Mohr, that City Council direct the Long Term Subcom-
mittee to continue to negotiate with the applicants for long term agreements
and come back with finalized agreements along the guidelines as presented to-
night, for consideration in June, and initiating an ordinance amendment
regarding small projects.
The roll call vote was as follows:
AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes
NOES: None
ABSENT: None

MEETING OPEN TO THE PUBLIC
No one in the audience addressed the Chair.

PUBLIC HEARINGS
AP-86-03, Appeal of a decision of the Board of Adjustment approving the ap-
plication of James McDowell for a Variance from the Ordinance Code to allow
for the subdivision of a parcel without the required frontage on a public
street located on an approximately 15,500 sq. ft. site located at 435 Neal
Street. Zoning for the property is R-1-6500 (Single-family Residential)
District
(Contd. Open from 4-15-86)
Mr. Swift presented his report {SR 86:131) dated April 15, 1986, regarding
this matter.

Mayor Brandes presented a letter from Mr. and Mrs. Russ Hatfield, 351Neal
Street, dated April 21, 1986, stating they have met with the applicants and
their consultants and are in support of the project. They advised they still
have concerns about future subdivision and new houses in their neighborhood
and about keeping the integrity of the neighborhood.

Mayor Brandes declared the continued public hearing open on this item.

Mr. Mike Cooper, representing the applicant, stated he would answer any
questions or concerns of Council.

5 - 5-6-86
