323 <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />PUD-81-22-1M, Application of Mozart Development Company and Regis Homes for a <br />major modification to an approved development plan for a commercial/office/ <br />residential complex to allow for a 520-unit condominium/apartment complex, to <br />be located on an approximately 20.6 acre site located generally in the area of <br />the northeast corner of the intersection of Stoneridge Drive and Stoneridge <br />Mall Road. Zoning for the property is PUD (Planned Unit Development)- <br />Commercial and Offices/High Density Residential and Open Space (Parks and <br />Recreation) District <br /> <br />Consider Adoption of Negative Declaration <br /> <br />Consider Request for Exemption from Growth Manaqement Program <br /> Mr. Swift presented his report (SR 86:538) dated December 16, 1986, <br />regarding this matter. <br /> <br /> Mayor. Mercer declared the public hearing open on these items. <br /> <br /> Mr. Mark Conroe, representing Mozart Development Company, presented the <br />proposed 520-unit high density residential project and the overall benefits of <br />the development. He stated that 15% of the units have been set aside as af- <br />fordable and low income housing. He advised that five units have been desig- <br />ned to meet the need of handicapped. He stated he concurs with the staff re- <br />port and conditions, except that condition No. 24 be deleted. <br /> <br /> Mr. Jeff Stack, representing Regis Homes, stated the only thing not in- <br />cluded in the staff report is the five handicapped units, for which there is a <br />strong response. He presented the site plan and answered various questions <br />raised by Council. <br /> <br /> Council discussed ensued regarding the widening of Foothill Road. Mr. <br />Conroe stated they agree to restrip as soon as the project goes forward and to <br />post a bond for their share of contribution for a signal and road widening. <br /> <br /> Councilmember Wilson asked if Mozart Homes would be responsible for the <br />entire improvements to Foothill Road if the Federal Government does not ap- <br />prove the grant application. Mr. Elliott stated he met with Caltrans in <br />Sacramento last week; he expects to hear something from them within a month. <br />The application will then have to be approved by the San Francisco office, <br />Omaha office, and Washington office. <br /> <br /> Mr. Chris Kinzel, representing TJKM, reviewed the traffic figures. He <br />stated this project will create less traffic than an office complex would <br />generate at this site. He stated that completion of the freeway improvements <br />on 1-580 will further alleviate traffic congestion in this area. <br /> <br /> Mr. Stack stated the financial window is critical; he asked for approval <br />of the project. <br /> <br /> Mr. Leo Heckathorn, 4202 Stanley Boulevard, asked that condition No. 24 be <br />included as a condition of approval because of traffic concerns. <br /> <br /> - 6 12-16-86 <br /> <br /> <br />
