261 <br />MEETING OPEN TO THE PUBLIC <br /> Ms. Kay Ayala, 4515 Gatetree Circle, stated that she lives next door to a <br />School Board member whose home was picketed during the recent teacher strike. <br />She felt this was a form of harrassment and asked if any ordinance could be <br />enacted to prevent this kind of thing from happening in the future. The City <br />Attorney advised there is little the City can do to regulate such incidents. <br /> <br /> PUBLIC HEARINGS <br />PUD-86-14, Application of Joseph Madden and Southern Pacific Transportation <br />Company for rezonin9 to PUD (Planned Unit Development)-Commercial and Offices <br />District for an approximately 7.6 acre site, the previous 100 foot width rail- <br />road right-of-way located immediately north of and parallel to Stanley <br />Boulevard, between Stanley Boulevard/First Street and a point approximately <br />3,350 feet northeasterly of that intersection <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Swift presented his report (SR 86:481) dated November 13, 1986, <br />regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the <br />negative declaration. <br /> <br /> Mr. Joseph Madden, 1544 Santa Rita Road, stated this action is a folloup <br />to a condition on the parcel map which requires that the former Southern <br />Pacific property be zoned consistent with the adjacent parcel. He stated he <br />concurs with the staff report and conditions. <br /> <br /> No one in the audience spoke in opposition to the application and negative <br />declaration. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, <br />that Resolution No. 86-537, determining on the basis of a review of initial <br />environmental study done for this project, that no significant environmental <br />impact would occur as outlined in the City's guidelines and that a negative <br />declaration is appropriate in connection with PUD-86-14, application of Joseph <br />Madden and Southern Pacific Transportation Company for rezoning to PUD <br />(Planned Unit Development)-Commercial and Offices District for an approximate- <br />ly 7.6 acre site, the previous 100 foot width railroad right-of-way located <br />immediately north of and parallel to Stanley Boulevard, between Stanley <br />Boulevard/First Street and a point approximately 3,350 feet northeasterly of <br />that intersection, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, <br />that Ordinance No. 1285, to be read by title only and waiving further reading <br />thereof, approving PUD-86-14, application of Joseph Madden and Southern <br />Pacific Transportation Company for rezoning to PUD (Planned Unit Development)- <br />Commercial and Offices District for an approximately 7~6 acre site, the pre- <br />vious 100 foot width railroad right-of-way located immediately north of and <br />parallel to Stanley Boulevard, between Stanley Boulevard/First Street and a <br /> <br /> - 7 11-18-86 <br /> <br /> <br />
