271 <br />an approximately 53 acre site, located generally in the area east of the ter- <br />minus of Junipero Street and San Jose Drive <br /> Mr. Swift presented his report (SR 86:501) dated November 18, 1986, <br />regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. Art Dunkley, 205 Main Street, representing the applicant, stated the <br />staff report is complete. He requested favorable support of the application. <br /> <br /> No one in the audience spoke in opposition to the item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Butler, <br />that Resolution No. 86-544, rescinding Resolution No. 86-482, adopted on Oc- <br />tober 7, 1986; making the appropriate findings as described in the staff re- <br />port dated October 7, 1986; determining the cancellation value of the property <br />as $241,600 and certify to the County Auditor the cancellation fee of $30,200, <br />based upon the amount equal to 12.5% of the cancellation value, as provided <br />for in Section 51283 of the Government Code; approving the request for tenta- <br />tive for tentative cancellations subject to the following conditions and con~ <br />tingencies: (a) that the applicant shall pay in full any cancellation fee and <br />deferred taxes as computed under provisions of Sections 51283 and 51283.1, and <br />unless the fee is paid or a Certificate of Cancellation of the Agreement is <br />issued within one year from date of recording the Tentative Certificate of <br />Cancellation such fees shall be recomputed as required by Section 51283.4; and <br />(b) that the applicant shall obtain all permits necessary to commence the <br />project; and directing the City Clerk to record the Certificate of Tentative <br />Cancellation setting forth the same of the land owner requesting cancellation, <br />the fact that Certificate of Cancellation of Contract will be issued and re- <br />corded at such time as such specified conditions and contingencies are satis- <br />fied, a description of the conditions and contingencies which must be satis- <br />fied, and legal description of the property, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brances, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />PUD-81-30-36D, Application of the Martin Company and the Prudential Insurance <br />Company of America for design review approval to construct an approximately <br />258,300 square foot, five-building multi-tenant office complex, to be located <br />on an approximately 18.7 acre site, located generally in the area south of <br />Stoneridge Drive, east of Willow Road, and west of Hacienda Drive. Zoning for <br />the property is PUD (Planned Unit Developmentl-Industrial/Commercial and <br />Offices District <br /> Mayor Mercer declared this item continued to the meeting of December 16, <br />1986, 8:00 p.m., in the Pleasanton Council Chambers, at the request of the <br />applicant. <br /> <br />MATTERS CONTINUED FOR DECISION <br />Adoption of Ordinance No. 1280, Approval of Koll Bernal Avenue Associates and <br />Patrician Associates, Inc., for development agreement approval for a business <br />park complex to be located on an approximately 99 acre site, located generally <br />in the area bounded by Bernal Avenue, Interstate 1-680, the Arroyo del Valle, <br /> <br /> 12 - 11-18-86 <br /> <br /> <br />
