267 <br /> Councilmember Brandes stated he felt this property should be in the ten <br />year urban land reserve. <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by <br />Councilmember Mohr, that Ordinance No. 1287, to be read by title only and <br />waiving further reading thereof, approving RZ-86-10, application of the City <br />of Pleasanton to prezone the TMI and Mason property to PUD (Planned Unit <br />Development)-Low Density Residential; the Gartung, Stevenson and Oleson prop- <br />erties to R-1-40; and the Wells Fargo Bank, Curdy, and Messa parcels to <br />Agriculture, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: Councilmember Brandes <br />ABSENT: None <br /> <br />RZ-86-11, Application of the City of Pleasanton to prezone an approximately <br />246 acre site to the PUD (Planned Unit DevelopmentI-High Density/Low Density/ <br />Rural Density Residential District located on both sides of Old Dublin Canyon <br />Road, generally in the area approximately 4,800 feet west of the intersection <br />of Foothill Road and Old Dublin Canyon Road <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Swift presented his report (SR 86:498) dated November 12, 1986, <br />regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the <br />negative declaration. <br /> <br /> Messrs. John Ferreri and Duncan Mattison, development partners, stated <br />they concur with the staff report. <br /> <br /> Mr. Brad Hirst, 2456 Minivet Court, representing the Panganiban property, <br />urged adoption of staff recommendations in compliance with the General Plan. <br /> <br /> Mr. Charles B. Snow, 39155 Liberty Street, Fremont, Attorney representing <br />Harold and William Kolb, spoke in opposition to the negative declaration, <br />stating there would be adverse impacts from this development caused by inade- <br />quate drainage and increased traffic. He presented a letter to Council defin- <br />ing the negative impacts. He asked that rezoning not be approved until fur- <br />ther study to resolve these problems. Mayor Mercer advised that these issues <br />should be presented at the time of development plan approval, not at the <br />rezoning application. <br /> <br /> Mr. Lewis, Dublin Canyon Road, stated there is an easement on his property <br />that is being used by trucks and other traffic going to the Schwerin property. <br />Mayor Mercer stated that the City cannot enforce rights on private property <br />but the owner has the right to prosecute trespassers. He suggested Mr. Lewis <br />meet with Mr. Levine, Attorney for the Schwerin property. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember But- <br />ler, that Resolution No. 86-540, determining on the basis of a review of ini- <br />tial environmental study done for this project, that no significant environ- <br />mental impact would occur as outlined in the City's guidelines and that a <br /> <br /> 10 - 11-18-86 <br /> <br /> <br />
