127 <br /> Council to look into this matter to see what can be done to get Twelve Oakes <br /> Homeowners Association to comply with the ordinance. <br /> <br /> After discussion, Council instructed City staff to inform Twelve Oaks <br /> Homeowners Association they have thirty days in which to comply with Ordinance <br /> No. 919. <br /> <br /> Mr. Frank Capilla, #9 Twelve Oakes Drive, stated this h'as been a very <br />lengthy problem that concerns the original developer. He stated that Twelve <br />Oakes Homeowners AsSociation hired an Attorney, Larry Smith, and they have <br />responded to letters from the City. He stated it was unclear what the City <br />expected them to do; they hired a plumber to make the drainage improvements <br />but were told by the City this was not sufficent. He stated he is unclear as <br />to whose responsibility this problem is. He advised that the Twelve Oakes <br />Homeowners Association are as anxious to get this problem solved as is Mr. <br />Stansell. <br /> <br /> Mayor Brandes instructed staff to work with all parties concerned to get <br />this matter resolved before the rainy season. <br /> <br />PUBLIC HEARINGS <br />North Pleasanton Improvement District No. 2, Assessment District 1986-7' <br />Consider Adoption of Negative Declaration <br /> (Contd. 0 en from 7-15-86, 8-5-86, and 9-2-86/ <br /> Mr. E~liott presented his report (SR 86:433) dated October 7, 1986, <br />regarding this matter. <br /> <br /> Mayor Brandes declared the public hearing open on this item. <br /> <br /> Mr. Sam Zullo, representing Mark Thomas & Company, presented revisions to <br />the Engineer's Report relative to refinancing a portion of the North Pleasan- <br />ton Improvement District No. 2; Hacienda in-tract acquisition; water district <br />broken up into two projects; and deletion of the freeway improvement from this <br />amended Engineer's Report, with the understanding that the freeway project <br />will be a separate district. <br /> <br /> Mr. Robert Brunsell, Bond Counsel for this Special District, set forth the <br />appropriate actions to be taken by Council relative to this matter. He ad- <br />vised that written protests have been received, therefore a resolution over- <br />ruling protests should be adopted. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Brandes declared the public hear- <br />ing closed. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Mohr, <br />that Resolution No. 86-474, determining on the basis of a review of initial <br />environmental study done for this project, that no significant environmental <br />impact would occur as outlined in the City's guidelines and that a negative <br />declaration is appropriate in connection with North Pleasanton Improvement <br />District No. 2, Assessment District 1986-7, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br /> - 7 10-7-86 <br /> <br /> <br />
