Zoning for the property is <br />PUD (Planned Unit Development)-Low Density and Rural Density Residential <br />District <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Swift presented his report (SR 87:95) dated March 3, 1987, regarding <br />this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the <br />negative declaration. <br /> <br /> Mr. Skip Spiering, representing HSC Development, stated he concurs with <br />the staff report. Councilmember Butler asked if he clearly understands the <br />implications of the Growth Management Program allocations. Mr. Spiering <br />stated that he does. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> Councilmember Mohr expressed concern regarding the methane gas <br />migrationfrom the old dump site. Mr. Swift advised that only two lots are <br />affected and that the mitigation measures in place will control this matter. <br />Mr. MacDonald stated he would not concede the City has any liability exposure; <br />the matter is the responsibility of the Pleasanton Garbage Service as the <br />landowner and that Pleasanton Garbage Service has taken reasonable measures to <br />control the problenm. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember <br />Brandes, that Resolution No. 87-92, determining on the basis of a review of <br />initial environmental study done for this project, that no significant <br />environmental impact would occur as outlined in the City's guidelines and that <br />a negative declaration is appropriate in connection with PUD-82-16-2M, <br />application of HSC Development for a major modification to an approved <br />development plan for a 39-unit single-family residential project to allow for <br />an increase to a 48 unit project, to be located on an approximately 42 acre <br />site, located generally on the north side of Crellin Road opposite the <br />intersection of Rhine Way and Crellin Road, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember Butler stated this plan appears to be a better layout of the <br />lots than before and he in favor of it, but he does not want to give the <br />appearance that Council will modify PUD's as a routine matter. <br /> <br /> - 5 3-3-87 <br /> <br /> <br />
