445 <br /> It was moved by Councilmember Butler, and seconded by Councilmember <br />Brandes, that Ordinance No. 1301, to be read by title only and waiving further <br />reading thereof, approving PUD-82-16-2M, application of HSC Development for a <br />major modificatioh to an approved development plan for a 39-unit single-family <br />residential project to allow for an increase to a 48 unit project, to be <br />located on an approximately 42 acre site located generally on the north side <br />of Crellin Road opposite the intersection of Rhine Way and Crellin Road, as <br />conditioned by the Planning Commission, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />AP-87-1~ Appeal of a decision of the Design Review Board approving a modified <br />application of C. J. Hinkston for design review approval to construct an <br />automobile rental/sales site located at the southeast corner of Rosewood Drive <br />and Old Santa Rita Road. Zoning for the property is C-S (Service Commercial) <br />District <br /> <br />Consider Adoption of Negative Declaration <br />(Contd. Open from 2-17-87) <br /> Mr. Swift presented his report (SR 87:88} dated March 3, 1987, regarding <br />this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the <br />negative declaration. <br /> <br /> Mr. Mike Cooper, Civil Engineer, representing the appellant and Avis Auto <br />Rental, stated the two conditions of approval that are of concern relate to <br />the reimbursement to CPS for street improvements along Old Santa Rita Road, <br />and requiring a freestanding monument sign of approximately seven feet in <br />height in lieu of the requested 20 foot high pylon type sign. Mr. Cooper <br />stated that at the time Old Santa Rita Road was improved he was working for <br />the consulting firm of Bissell & Karn; CPS assured all property owners at the <br />time of the street improvements they would not be required to pay any of the <br />expenses. Mr. Cooper stated he felt it is unfair for Mr. Hinkston to be <br />required to pay this reimbursement fee of $8,508.00 to CPS when other property <br />owners did not have to do so. He stated that with regard to the freestanding <br />sign, Avis feels they need the freeway exposure to.make their business known <br />and would request that the twenty foot high pylon sign be allowed. He stated <br />they are willing to remove the sign after three years and replace it with the <br />seven foot monument sign. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember <br /> Butler, that Resolution No. 87-93, determining on the basis of a review of <br /> initial environmental study done for the project, that no significant <br /> environmental impact would occur as outlined in the City's guidelines and that <br /> a negative declaration is appropriate in connection with AP-87-1, appeal of a <br /> decision of the Design Review Board approving a modified application of C. J. <br /> Hinkston for design review approval to construct an automobile rental/sales <br /> facility on an approximately 0.8 acre site located at the southeast corner of <br /> <br /> 6 - 3-3-87 <br /> <br /> <br />
