293 <br />retail facility to be located on an approximately 2.6 acre site located on the <br />north side of Pimlico Drive, approximately 650 feet east of the intersection <br />of Santa Rita Road and Pimlico Drive <br /> <br />Consider Adoption of Neqative Declaration <br /> Mr. Swift presented his report (SR 87:362) dated August 18, 1987, regard- <br />ing this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the <br />negative declaration. <br /> <br /> Mr. Mike Cooper, 200 Rose Avenue, representing the applicant, stated the <br />project was built to suit the situation; Budget Rent-A-Car will lease the <br />building for ten years. He concurred with the staff report and conditions. <br />He presented a letter from Fairlands Park Association supporting the building <br />of this project. He stated Pleasanton Meadows Homeowners Association sup- <br />ported the project at previous hearings. <br /> <br /> Councilmember Brandes expressed concern regarding freeway alignment and <br />possible cost exposure to the City if part of this property is needed for <br />freeway improvements. Mr. Cooper stated that the project was designed based <br />on the best knowledge at this time by City staff and other consultants. Mr. <br />Elliott stated there is a very slim possibility of this happening but he could <br />not guarantee it as the lines have not been finaled. Mr. Swift stated there <br />is flexibility built into the plan. Councilmember Brandes stated he felt <br />there needs to be more landscaping and buffering around the project. Mr. <br />Cooper stated that landscaping of the freeway portion will be approved by Cal- <br />trans and will be maintained by the developer. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, <br />that Resolution No. 87-378, determining on the basis of a review of initial <br />environmental study done for this project, that no significant environmental <br />impact would occur as outlined in the City's guidelines and that a negative <br />declaration is appropriate in connection with PUD-87-11, application of Brook- <br />side Development Company for Planned Unit Development rezoning and development <br />plan approval for an automobile sales and retail facility to be located on an <br />approximately 2.6 acre site located on the north side of Pimlico Drive, ap- <br />proximately 650 feet east of the intersection of Santa Rita Road and Pimlico <br />Drive, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, <br />that Ordinance No. 1332, to be read by title only and waiving further reading <br />thereof, and finding that the rezoning and development plan are consistent <br />with the General Plan and the purposes of the PUD ordinance, approve PUD-87- <br />11, application of Brookside Development Company for Planned Unit Development <br />rezoning and development plan approval for an automobile sales and retail <br />facility to be located on an approximately 2.6 acre site located on the north <br /> <br /> 9 - 8-18-87 <br /> <br /> <br />
