307 <br /> Councilmember Butler stated this is poor policy and makes it extremely <br />difficult for low cost units to be built in the City. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Wil- <br />son, that Ordinance No. 1336, to be read by title only and waiving further <br />reading thereof, modifying the City's Growth Management Ordinance, be <br />introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Wilson, and Mayor Mercer <br />NOES: Councilmembers Butler and Mohr <br />ABSENT: None <br /> <br />Adjustment of Water Service Fees and Water Connection Fees <br /> Mr. Walker presented his report (SR 87:383) dated August 18, 1987, regard- <br />ing this matter. <br /> <br /> It was moved by Councilmembr Butler, and seconded by Councilmember Bran- <br />des, that Resolution No. 87-382, amending Resolution No. 77-123 to include <br />revised water service charges and water connection fees as set forth in Staff <br />Report 87:383, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Agreements for Extension of Bernal Avenue and Liftin9 of Vineyard Avenue <br />Buildin9 Moratorium <br /> Mr. Swift presented his report (SR 87:378) dated August 18, 1987, regard- <br />ing this matter. <br /> <br /> Mr. MacDonald stated that this item will be considered in three separate <br />actions: Councilmember Wilson will be required to abstain from participation <br />in the first action because of Conflict of Interest; and that Councilmembers <br />Butler, Mohr and Mayor Mercer will be required to select by random draw to see <br />who will participate in the second and third actions because of Conflict of <br />Interest. <br /> <br />Approve Agreement with Lins for Southerly Extention of Bernal Avenue <br /> Mr. Martin Inderbitzen, Attorney, 62 West Neal Street, representing the <br />Lin-Kottinger Ranch property, stated he wholeheartedly favors this matter. <br /> <br /> Council discussion ensued regarding who would pay for any expenditures <br />over $1.5 million if the estimates for the improvements were incorrect. Mr. <br />Inderbitzen stated that the estimate of MacKay & Somps for the basic improve- <br />ments is set at $1.3 million; he felt the $1.5 million should take care of any <br />unanticipated expenses, however, this figure does not include soundwalls, <br />noise mitigation measures, etc. He stated he did not have authority from the <br />Lin's to commit for the expense of any additional improvements. <br /> <br /> Mr. Don Feyrer, 683 Windmill Lane, stated he is concerned about the eleva- <br />tion of Bernal Avenue, which could cause excessive speeding. He stated there <br />should be a soundwall on the lower end of Bernal Avenue, and he would like to <br />have input regarding the design of that soundwall. <br /> <br /> Mr. Charles Katz, 635 Windmill Lane, stated he is interested in getting a <br />soundwall to protect and maintain the lifestyle of this neighborhood. <br /> <br /> - 16 - 8-18-87 <br /> <br /> <br />
