307 Councilmember Butler stated this is poor policy and makes it extremely difficult for low cost units to be built in the City. It was moved by Councilmember Brandes, and seconded by Councilmember Wil- son, that Ordinance No. 1336, to be read by title only and waiving further reading thereof, modifying the City's Growth Management Ordinance, be introduced. It was moved by Councilmembr Butler, and seconded by Councilmember Bran- des, that Resolution No. 87-382, amending Resolution No. 77-123 to include revised water service charges and water connection fees as set forth in Staff Report 87:383, be adopted. Mr. MacDonald stated that this item will be considered in three separate actions: Councilmember Wilson will be required to abstain from participation in the first action because of Conflict of Interest; and that Councilmembers Butler, Mohr and Mayor Mercer will be required to select by random draw to see who will participate in the second and third actions because of Conflict of Interest. Approve Agreement with Lins for Southerly Extention of Bernal Avenue Mr. Martin Inderbitzen, Attorney, 62 West Neal Street, representing the Lin-Kottinger Ranch property, stated he wholeheartedly favors this matter. Council discussion ensued regarding who would pay for any expenditures over $1.5 million if the estimates for the improvements were incorrect. Mr. Inderbitzen stated that the estimate of MacKay & Somps for the basic improve- ments is set at $1.3 million; he felt the $1.5 million should take care of any unanticipated expenses, however, this figure does not include soundwalls, noise mitigation measures, etc. He stated he did not have authority from the Lin's to commit for the expense of any additional improvements. Mr. Don Feyrer, 683 Windmill Lane, stated he is concerned about the eleva- tion of Bernal Avenue, which could cause excessive speeding. He stated there should be a soundwall on the lower end of Bernal Avenue, and he would like to have input regarding the design of that soundwall. Mr. Charles Katz, 635 Windmill Lane, stated he is interested in getting a soundwall to protect and maintain the lifestyle of this neighborhood. - 16 - 8-18-87
