453 <br /> Ms. Janet Linfoot, 6300 Alisal, stated Mr. Spotorno's right have to be <br />observed. She felt the problem is bas,ically the density. She asked if densi- <br />ty could not be done later; stating that when he is ready to build then every- <br />one can come back and discuss it. She stated her main concern is the flooding <br />problems. She felt the environment assessment did not adequately address this <br />issue. <br /> <br /> Mr. Inderbitzen rebutted by stating Mr. Spotorno is not a developer. He <br />did not feel the opponents were far apart from what Mr. Spotorno is requesting <br />which is consistent with rural. He stated he cannot predict what public im- <br />provements will be put in. He advised the General Plan could not be changed <br />later; he urged support of the application. He stated the density would be <br />one unit per five acres or less, identical to what the majority of people here <br />tonight have. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed on the application and the negative declaration. <br /> <br /> Mayor Mercer stated that the Happy Valley residents and the City have <br />spent many hours working out a reasonable approach to preserving the rural <br />atmosphere in this area. The Council went on record upholding the residents <br />desire to remain unincorporated. He stated he is committed to maintaining <br />that position. He felt several items in the environmental assessment were <br />incorrect and staff needs to recognize this fact. <br /> <br /> Councilmember Butler felt there were some misconceptions and denial of the <br />application is not going to do anything to clear them up. His concern about <br />taking no action at th'is point is the City is in effect letting go the feeling <br />whats being asked for is half acre lots or so and that simply is not the case. <br />He felt a rural density district was created to do just exactly what the resi- <br />dents are asking for. The district was created in order to try and maintain <br />the rural environment; he did not feel there should be that much difference of <br />opinion. Approving this request would not be in opposition to the commitment <br />made to the Happ_w~Valley residents a couple of years ago. <br /> <br /> Councilmember Wilson stated there is not any buyers now but there could be <br /> buyers later. He did not see any point in changing the General Plan designa- <br /> tion. If Council wants to annex this area then they should direct staff to <br /> spend time studying the drainage, roads, etc. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Wil- <br /> son, that Resolution No. 87-559, denying GP-87-4, application of Alex Spotorno <br /> to amend the Land Use Element designation of the General Plan of an approxi- <br /> mately 145 acres of the 160 acre site located generally in the area northeast <br /> of the intersection of Alisal Street and Happy Valley Road from Public Health <br /> and Safety to Rural Density Residential, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Mohr, Wilson, and Mayor Mercer <br /> NOES: Councilmember Butler <br /> ABSENT: None <br /> <br /> Because of the above motion, no action was taken on the negative declara- <br /> tion in connection with this item. <br /> <br /> GP-85-10, Application of John Caroline for a General Plan amendment to the <br /> Land Use Element of the General Plan to redesignate an approximately 0.32 acre <br /> <br /> - 9 12-15-87 <br /> <br /> <br />
