Council discussion ensued regarding possible ways to solve the problem. <br />The City Attorney advised that the improvements to be made are on the property <br />of the Hyde Park homeowners and that permission will have to be secured from <br />them before the City can proceed with any work. He stated that all threepar- <br />ties: American Savings, Hyde Park Homeowners, and Churchill Drive property <br />owners are going to have to compromise if a solution is to be reached. He <br />stated the City has leverage to require American Savings to move the sidewalk. <br />He advised that responsibility of the fence is typically shared between neigh- <br />bors on both sides of the fence; he advised that the Churchill Drive people <br />could have the fence six inches into their property line if they so desired. <br />He felt it premature to spend any money on improvements until all parties are <br />in agreement. <br /> <br /> Mr. Art Larson, Churchill Drive, stated he would prefer removal of the <br />eucalyptus trees and replaced with more appropriate trees, as well as new <br />fence and sidewalk. He asked why the City approved the incorrect improve- <br />ments. Mr. MacDonald advised that they City has never accepted or signed off <br />for these improvements. <br /> <br /> Mayor Mercer asked if both parties, Hyde Park Homeowners and Churchill <br />Drive property owners, would be willing to meet with City staff to further <br />discuss possible solutions to this matter. Both groups expressed willingness <br />to meet in an attempt to resolve the issue. <br /> <br /> Councilmember Wilson asked who applied for the occupancy permits, and <br />about title insurance without all conditions being satisfied. Staff stated <br />they would have to investigate this matter. <br /> <br /> After further discussion, Mayor Mercer continued this matter for two <br />weeks, or until Hyde Park Homeowners Association, Churchill Drive property <br />owners, American Savings, and City staff could meet and discuss solutions to <br />the problems related to trees, fences, and sidewalks; and report back to the <br />City Council. He asked that quotes for the three separate improvements be <br />included in the report. <br /> <br /> Councilmember Brandes requested that staff prepare a report on the policy <br />for allowing financial institutions in the downtown area, now that the down- <br />town study has been completed. <br /> <br />CITY COUNCIL COMMITTEE REPORTS <br /> There were no City Council Committee Reports presented at this meeting. <br /> <br />MEETING OPEN TO THE PUBLIC <br /> Ms. June Jardine, 3894 Hot Springs Court, requested Council assistance in <br />starting a drug awareness program that would involve everyone in the communi- <br />ty. She stated there are programs in other cities; she cited the CASA program <br />(Citizens Against Substance Abuse). She suggested several ways that might be <br />used by the City to get involved in such a project. Mayor Mercer requested <br />Ms. Jardine to get additional information to present to the Recreation and <br />Police Departments.
