No action was required or taken by Council on the item. <br /> <br />MATTERS INITIATED BY COUNCILMEMBERS <br />Discussion Regardin~ the Hyde Park Project <br /> Mayor Mercer stated he requested this item be placed on the agenda after a <br />discussion with Mr. Persky. <br /> <br /> Mr. Robert Persky, 4276 Churchill Drive, stated that a satisfactory solu- <br />tion to the fence, tree, and sidewalk problems has not been resolved in the <br />Churchill Drive area, after four years of efforts on the part of the property <br />owners, City Council, and City staff. He presented background information, <br />stating that Council approved a tree removal plan in the amount of $20,000.00, <br />to be paid by America Savings. He advised the Hyde Park Homeowners originally <br />agreed to this plan, but later decided that some of the eucalyptus trees <br />should be saved. American Savings has never paid any money toward these im- <br />provements. A new plan has now been presented that will cost approximately <br />$34,700.00, that would save and trim some of the eucalyptus trees and remove <br />and replace others. He stated the trees adversely impact Churchill Drive <br />homes and he would like them all removed and replaced with more appropriate <br />shrubbery. Mr. Persky stated that at one time the $20,000.00 was sufficient <br />to perform the requested improvements; now there is a conflict between Hyde <br />Park Homeowners and American Savings and nothing has been done about the im- <br />provements. He felt City staff had not fairly represented the Churchill Drive <br />property owners. <br /> <br /> Mr. Cal Heihn, 4356 Fairlands Drive, President of the Hyde Park Homeowners <br />Association, stated that the proposed improvements do something to their prop- <br />erty; their titles are free and clear and should not be encroached upon. He <br />stated their homeowners group originally agreed to the proposed improvement <br />plan; later when nothing was done some of the property owners decided that <br />several of the eucalyptus trees should be saved. He stated his group has <br />tried to cooperate; they had worked out a deal until American Savings did not <br />come through with the $20,000.00. He felt to blame the Hyde Park Homeowners <br />Association because of American Savings' lack of commitment is unfair. He <br />stated he would not subject his 35'homeowners to a solution that is not fair <br />to them. He added that American Savings has been uncooperative in his at- <br />tempts to reach them by telephone to discuss this matter. <br /> <br /> - 3 11-3-87 <br /> <br /> <br />
