Councilmember Brandes suggested the next two public hearings be considered <br /> together. Council concurred. <br /> <br /> AP-88-01, Appeal by the City Council of a decision of the Design Review <br /> Board's approval of Z-87-492, Application of Exxon Corporation for desiqn re- <br /> view approval to demolish an existing service station and construct an ap- <br /> proximately 2,600 sq. ft. service station building with 4~092 sq. ft. canopy <br /> area on an approximately 38,594 sq. ft. site located at 3192 Santa Rita Road. <br /> Zoning for the property is CN (Neighborhood Commercial) District <br /> <br />AP-88-02, Appeal by the City Council of a decision of the Board of Adjust- <br />ment's approval of V-87-30, Application of Exxon Company U.S.A. for a variance <br />from the Municipal Code to permit the installation of a second free-standinq <br />sign where one such sign is permitted and to allow for a comprehensive signing <br />program to exceed the maximum sign area permitted for a service station use to <br />be located at 3192 Santa Rita road. Zoning for the property is C-N (Neighbor- <br />hood Commercial) District <br /> Mr. Swift presented his reports {SR 88:40 and SR 88:54) dated February 2, <br /> 1988, regarding these two items. <br /> <br /> Mayor Mercer declared the public hearing open on the two items. <br /> <br /> Mr. A1Wofford, Major Engineering Company, representing Exxon Company, <br />stated he agrees that the sign should be dressed up. He asked that the <br />original application for a variance be upheld. <br /> <br /> No one in the audience spoke in opposition to the two items. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> Councilmember Brandes stated he requested these two items be appealed be- <br />cause he had concerns regarding the signage, the location of the driveway, the <br />number of parking spaces provided, and cars up on jacks. Mr. Swift advised <br />that the driveway has been moved farther away from the intersection and <br />drivers will be able to see pedestrians much easier; the Code provides only a <br />minimum number of parking space, not a maximum, and this application provides <br />for ten parking spaces which meets the requirements; there will not be any <br />towing services provided with the station and it is against the Code to have a <br />car on jacks. Councilmember Brandes asked that Exxon has dedicated land for <br />deceleration lane. Mr. Swift advised that they have and they will pay their <br />prorata share of cost. <br /> <br /> Councilmember Brandes stated he did not feel it was fair to the developers <br />of the Shell Service Station on Santa Rita to be restricted in their hours of <br />operation and now to allow no limitation on hours of operation for this ser- <br />vice station. Councilmember Wilson stated that maybe this is the time to en- <br />act an ordinance to limit the hours of operation of service stations in <br />residential neighborhoods. <br /> <br /> After discussion, it was moved by Councilmember Wilson, and seconded by <br />Councilmember Butler, that Resolution No. 88-53, denying the appeal of the <br />City Council, Case AP-88-01, and upholding the action of the Design Review <br />Board in approving Case Z-87-492, application of Exxon Corporation for design <br />review approval to demolish an existing service station and to construct an <br />approximately 2,600 square foot service station building with an approximately <br /> <br /> - 6 - 2-2-88 <br /> <br /> <br />
