4,100 square foot canopy area to be located on an approximately 38,600 square <br /> foot site located at 3192 Santa Rita Road, be adopted. <br /> The roll call vote was as follows: <br />(2) AYES: Councilmembers Butler, Mohr, Wilson, and Mayor Mercer <br />{]C) NOES: Councilmember Brandes <br />{~) ABSENT: None <br />~ It was moved by Councilmember Wilson, and seconded by Councilmember But- <br />=:::[ ler, that Resolution No. 88-54, denying the appeal of the City Council, Case <br />.:::[ AP-88-02; making the findings that special circumstances unique to the site <br /> can be found, that the proposal will not constitute a grant of special <br /> privilege, and that the health, safety and general welfare of the surrounding <br /> area are not jeopardized by the request; and upholding the decision of the <br /> Board of Adjustment in approving V-87-30, application of Exxon Company, U.S.A. <br /> for a variance from the Municipal Code to permit the installation of a second <br /> free-standing sign where one such sign is permitted and to allow for a com- <br /> prehensive signing program to exceed the maximum sign area permitted for a <br />' service station use to be located at 3192 Santa Rita Road, subject to the fol- <br /> lowing conditions: {1} that the developer apply for and receive design review <br /> approval for the proposed sign program; and (2) that the freestanding price <br /> information sign shall be located in the landscaping area east of the proposed <br /> West Las Positas Boulevard driveway entrance to the service station site, be <br /> adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Wilson, and Mayor Mercer <br /> NOES: Councilmember Brandes <br /> ABSENT: None <br /> <br /> AP-88-03, Appeal by the City Council of a decision of the Design Review <br /> Board's approval of Z-87-564, Application of Ted Mavridis for design review <br /> approval to construct a nineteen unit apartment complex with an approximately <br /> 1~150 sq. ft. retail commercial space to be located at 4319 Railroad Street. <br /> Zoning for the property is C-C (Central Commercial) District <br /> Mr. Swift presented his report {SR 88:53) dated February 2, 1988, regard- <br /> ing this matter. <br /> <br /> Councilmember Brandes stated he asked that this item be appealed based <br /> upon certain needs of the Community Development Agency with regard to addi- <br /> tional parking areas in the downtown. He stated he has no problem with the <br /> design of the project but is concerned that this area might be determined in <br /> the future to be the best location for a parking area. He asked if this area <br /> could be placed in a "Study" District for six months so that Council could be <br /> fully aware of the ramifications of the proposed project as it relates to the <br /> Community Development Agency actions. He added that the property owner would <br /> be protected by this action. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. Mike Goldsworthy, Architect representing the applicant, stated he has <br /> been working closely with staff on the plans and has moved the project to the <br /> north side of the property to accommodate future parking areas on adjoining <br /> properties. <br /> <br /> Mr. A1 Bronzini, 719 Main Street, President of the Downtown Association, <br /> stated it is the position of the Downtown Association that they would like no <br /> new projects approved in the downtown until the Specific Plan is adopted and <br /> <br /> 7 - 2-2-88 <br /> <br /> <br />
